“न्याय तक पहुँच (Access to Justice) लोकतंत्र और विधि के शासन (Rule of Law) की आधारशिला है।

📌 Question (English)

“Access to Justice is the cornerstone of democracy and the Rule of Law. Analyze the challenges related to pendency of cases, judicial infrastructure, and access to justice in India. Discuss the reforms required in the judicial system.” (250 words)

"Justice delayed is justice denied."

  • E-Courts
  • Virtual Hearings
  • Online Case Management

  • Arbitration
  • Mediation
  • Lok Adalats

✍️ Answer (English – Detailed)

🔹 Introduction

The Indian Constitution guarantees justice, liberty, and equality to all citizens. The judiciary plays a crucial role in protecting rights, ensuring constitutional supremacy, and upholding the Rule of Law.

However, growing pendency of cases, shortage of judges, high litigation costs, and inadequate judicial infrastructure have made access to timely justice a major challenge.

🔹 Major Challenges Before the Indian Judiciary

1. ⚖️ Growing Pendency of Cases

  • Millions of cases remain pending across courts.
  • Judicial delays often extend for years.

👉 Result:
"Justice delayed is justice denied."

2. 👨‍⚖️ Shortage of Judges

  • Low judge-to-population ratio.
  • Large number of vacancies.
  • Increasing workload on existing judges.

3. 🏛️ Weak Judicial Infrastructure

  • Lack of modern facilities.
  • Shortage of courtrooms and staff.
  • Limited access in rural areas.

4. 💰 High Cost of Justice

  • Expensive legal representation.
  • Lengthy litigation process.
  • Difficult access for economically weaker sections.

5. 🌍 Lack of Legal Awareness

Many citizens remain unaware of their rights and legal remedies.

🔹 Reforms Required

1. 👨‍⚖️ Increase Judicial Strength

Fill vacancies and appoint more judges.

2. 💻 Digitization of Judiciary

  • E-Courts
  • Virtual hearings
  • Online case tracking

can improve efficiency.

3. ⚡ Alternative Dispute Resolution (ADR)

  • Arbitration
  • Mediation
  • Lok Adalats

can reduce court burden.

4. 🏛️ Strengthen Infrastructure

Improve physical and technological infrastructure.

5. 🤝 Free Legal Aid

Expand legal aid services for vulnerable groups.

6. 📜 Procedural Reforms

  • Reduce unnecessary adjournments.
  • Introduce time-bound case management.

🔹 Analysis

  • Public trust in the judiciary remains strong.
  • However, delays and limited access undermine the effectiveness of justice delivery.
  • Judicial reforms are essential not only for efficiency but also for social justice.

🔹 Conclusion

Thus, effective and timely access to justice is essential for a vibrant democracy and the Rule of Law.
Through digitization, capacity enhancement, ADR mechanisms, and institutional reforms, India can build a more accessible, transparent, and efficient judicial system.
