Article 1 – Union of States


Article 1 states:

“India, that is Bharat, shall be a Union of States.”


The Constitution uses the word Union, not Federation.

This means India is a Union with federal features.


Exam Point: India is not a federation formed by agreement of states; states cannot secede from the Union.


2️⃣ Article 3 – Formation of New States


Article 3 gives Parliament the power to:

• Form a new state

• Alter boundaries of a state

• Change the name of a state


Example: Telangana was created under Article 3.


Exam Trap: State legislature gives opinion, but final power lies with Parliament.


3️⃣ Article 14 – Equality before Law


Article 14 guarantees:

• Equality before Law

• Equal Protection of Laws


It applies to all persons (citizens and non-citizens).


Important Concept: Reasonable classification is allowed.

Reservation does not violate Article 14.


4️⃣ Article 19 – Six Fundamental Freedoms


Article 19 provides six freedoms to citizens:

• Freedom of Speech

• Freedom of Assembly

• Freedom of Association

• Freedom of Movement

• Freedom of Residence

• Freedom of Profession


Important: Article 19 is available only to citizens.


5️⃣ Article 21 – Right to Life and Personal Liberty


Article 21 states that no person shall be deprived of life or personal liberty except according to procedure established by law.


The Supreme Court has expanded its scope to include:

• Right to Privacy

• Right to Dignity

• Right to Clean Environment


It applies to both citizens and non-citizens.


6️⃣ Article 32 – Constitutional Remedies


Dr. B.R. Ambedkar called Article 32 the “Heart and Soul of the Constitution.”


It allows individuals to move directly to the Supreme Court for enforcement of Fundamental Rights.


Five Writs:

• Habeas Corpus

• Mandamus

• Prohibition

• Certiorari

• Quo Warranto


7️⃣ Article 44 – Uniform Civil Code


Article 44 is part of the Directive Principles of State Policy.


It aims to establish a Uniform Civil Code for all citizens.


It is not enforceable in court.


8️⃣ Article 51A – Fundamental Duties


Added by the 42nd Amendment (1976).


There are currently 11 Fundamental Duties.


Examples:

• Respect the Constitution

• Respect the National Flag and Anthem

• Promote scientific temper


These duties are not legally enforceable.


9️⃣ Article 356 – President’s Rule


Article 356 is imposed when constitutional machinery fails in a state.


It allows the President to take control of the state government.


Note: National Emergency is under Article 352.


🔟 Article 368 – Amendment of Constitution


Article 368 explains the procedure for amending the Constitution.


Three types of amendments:


Simple Majority


Special Majority


Special Majority + State Ratification


Example: GST Amendment required state ratification.

1️⃣ अनुच्छेद 1 – राज्यों का संघ


अनुच्छेद 1 कहता है:

“India, that is Bharat, shall be a Union of States.”


संविधान में “Union” शब्द का प्रयोग किया गया है, “Federation” का नहीं।

इसका अर्थ है कि भारत संघात्मक विशेषताओं वाला संघ है।


परीक्षा बिंदु: राज्य संघ से अलग नहीं हो सकते।


2️⃣ अनुच्छेद 3 – नए राज्यों का गठन


अनुच्छेद 3 संसद को यह शक्ति देता है कि वह:

• नया राज्य बना सके

• राज्य की सीमाएँ बदल सके

• राज्य का नाम बदल सके


उदाहरण: तेलंगाना का गठन इसी अनुच्छेद के तहत हुआ।


अंतिम निर्णय संसद का होता है।


3️⃣ अनुच्छेद 14 – विधि के समक्ष समानता


यह अनुच्छेद दो बातें सुनिश्चित करता है:

• विधि के समक्ष समानता

• विधि का समान संरक्षण


यह सभी व्यक्तियों पर लागू होता है।


आरक्षण इस अनुच्छेद का उल्लंघन नहीं है।


4️⃣ अनुच्छेद 19 – छह स्वतंत्रताएँ


यह अनुच्छेद केवल नागरिकों को छह स्वतंत्रताएँ देता है:


• वाक् स्वतंत्रता

• सभा की स्वतंत्रता

• संघ बनाने की स्वतंत्रता

• आवागमन की स्वतंत्रता

• निवास की स्वतंत्रता

• व्यवसाय की स्वतंत्रता


यह अधिकार केवल नागरिकों के लिए है।


5️⃣ अनुच्छेद 21 – जीवन और व्यक्तिगत स्वतंत्रता का अधिकार


किसी भी व्यक्ति को विधि द्वारा स्थापित प्रक्रिया के बिना जीवन या स्वतंत्रता से वंचित नहीं किया जा सकता।


उच्चतम न्यायालय ने इसमें कई अधिकार शामिल किए हैं:

• निजता का अधिकार

• गरिमा के साथ जीवन

• स्वच्छ पर्यावरण का अधिकार


6️⃣ अनुच्छेद 32 – संवैधानिक उपचार


डॉ. भीमराव अंबेडकर ने इसे संविधान का “हृदय और आत्मा” कहा।


मौलिक अधिकारों के उल्लंघन पर सीधे उच्चतम न्यायालय जाया जा सकता है।


पाँच प्रकार की रिट:

• हैबियस कॉर्पस

• मंडामस

• प्रोहिबिशन

• सर्टियोरारी

• क्वो वारंटो


7️⃣ अनुच्छेद 44 – समान नागरिक संहिता


यह राज्य के नीति निर्देशक तत्वों का हिस्सा है।


इसका उद्देश्य सभी नागरिकों के लिए समान नागरिक कानून बनाना है।


यह न्यायालय में लागू नहीं किया जा सकता।


8️⃣ अनुच्छेद 51A – मौलिक कर्तव्य


यह 42वें संशोधन (1976) द्वारा जोड़ा गया।


वर्तमान में 11 मौलिक कर्तव्य हैं।


उदाहरण:

• संविधान का सम्मान करना

• राष्ट्रीय ध्वज का आदर करना

• वैज्ञानिक दृष्टिकोण अपनाना


ये विधिक रूप से बाध्यकारी नहीं हैं।


9️⃣ अनुच्छेद 356 – राष्ट्रपति शासन


जब किसी राज्य में संवैधानिक तंत्र विफल हो जाता है, तब राष्ट्रपति शासन लगाया जाता है।


राष्ट्रीय आपातकाल अनुच्छेद 352 के अंतर्गत घोषित किया जाता है।


🔟 अनुच्छेद 368 – संविधान संशोधन


यह अनुच्छेद संविधान संशोधन की प्रक्रिया बताता है।


तीन प्रकार के संशोधन होते हैं:


साधारण बहुमत


विशेष बहुमत


विशेष बहुमत + राज्यों की स्वीकृति


उदाहरण: GST संशोधन के लिए राज्यों की स्वीकृति आवश्यक थी।
