Recently, India has amended income tax rules and clarified that gains arising from assets acquired before April 1, 2017, will remain outside the scope of General Anti-Avoidance Rules (GAAR).
GAAR is an anti-tax avoidance law in India designed to curb tax evasion and prevent revenue leakage. It came into effect on 1st April 2017 and its provisions are included under the Income Tax Act, 1961.
The concept of GAAR was recommended by the Parthasarathi Shome Committee.
The main objective of GAAR is to prevent revenue losses caused by aggressive tax avoidance strategies adopted by companies and individuals.
GAAR acts as a tool to check aggressive tax planning, especially those transactions or business arrangements that are entered into with the primary objective of avoiding tax.
Importantly, GAAR applies even to transactions that are legally valid but structured to reduce tax liability.
However, GAAR provisions apply only if the tax benefit exceeds ₹3 crore in a financial year.
Under GAAR, tax authorities have wide powers to declare any arrangement as an “Impermissible Avoidance Arrangement” (IAA) and recompute income and tax liability accordingly.
The recent amendment provides relief by ensuring that investments made before April 1, 2017, are not covered under GAAR.
