विशाखा में CEDAW का महत्व

सर्वोच्च न्यायालय ने संवैधानिक अधिकारों की व्याख्या करते समय उन अंतरराष्ट्रीय मानकों का सहारा लिया जो भारतीय संविधान के मौलिक अधिकारों के अनुरूप थे।

इससे एक महत्वपूर्ण सिद्धांत सामने आया:

विधायी रिक्तता

का अर्थ है किसी विषय पर पर्याप्त विशिष्ट कानून का न होना।

1997 में:
