Why are the E-Commerce Rules in News?
The Department of Consumer Affairs has amended the Consumer Protection (E-Commerce) Rules, 2020 through the Consumer Protection (E-Commerce) (Amendment) Rules, 2026.
The amended framework strengthens consumer protection in digital marketplaces and will come into force from 1 January 2027.
Why Were the Rules Amended?
India's online retail ecosystem has expanded rapidly. Along with growth, concerns have emerged about misleading discounts, manipulated search results, hidden sponsored listings, dark patterns and inadequate grievance redressal.
The amendments seek to improve transparency without imposing unnecessary barriers on legitimate e-commerce activity.
Prior Price Rule
When a platform advertises a price reduction, it must display both the reduced price and the prior price.
The prior price is defined as the lowest price at which the product or service was offered on the platform during the preceding 30 days.
Why is the Prior Price Rule Important?
This requirement is intended to prevent artificial discounts. For example, a seller should not increase a price immediately before a sale and then claim that the product is being offered at a massive discount.
The 30-day reference period provides consumers with a clearer benchmark.
Search Ranking Transparency
The amended rules strengthen provisions relating to search rankings on marketplace platforms.
E-commerce entities cannot manipulate search results in a way that deliberately misleads consumers or unfairly distorts the relevance of listings.
Sponsored Listings
Paid or sponsored listings must be clearly and prominently identified.
This allows consumers to distinguish between organic search results and advertisements or paid promotional placement.
Dark Patterns
The rules also reinforce compliance with the Guidelines for Prevention and Regulation of Dark Patterns, 2023.
Dark patterns are deceptive interface designs that manipulate users into actions they may not otherwise have chosen, such as automatically adding products, creating false urgency or making subscription cancellation unnecessarily difficult.
Annual Self-Audit
E-commerce entities will be required to conduct an annual self-audit relating to dark-pattern compliance and prominently display the relevant compliance certificate.
This introduces an internal accountability mechanism for digital platforms.
National Consumer Helpline
E-commerce entities must participate in the convergence process of the National Consumer Helpline.
The National Consumer Helpline provides a central mechanism through which consumers can register grievances and seek assistance.
Grievance Officer Requirements
The amended framework strengthens grievance-handling obligations. Consumers must be provided appropriate records of complaints received by grievance officers.
This can improve traceability and reduce disputes over whether a complaint was properly registered.
Seller and Product Disclosures
Marketplace entities must provide important information regarding sellers and products so that consumers can make informed purchasing decisions.
For imported goods, information concerning the importer and country of origin is also relevant under the revised framework.
Consumer Information and Consent
The amended rules strengthen requirements around use of consumer information. Where specified uses require consent, platforms must obtain clear and affirmative consent rather than relying on confusing or pre-selected choices.
Consumer Protection Act, 2019
The E-Commerce Rules operate under the Consumer Protection Act, 2019.
The Act modernised India's consumer-protection framework and established the Central Consumer Protection Authority, commonly known as CCPA.
What is CCPA?
The Central Consumer Protection Authority protects consumer rights and acts against unfair trade practices and misleading advertisements.
It can investigate violations and issue directions under the Consumer Protection Act.

Prior Price Rule
यदि कोई platform किसी वस्तु पर price reduction दिखाता है तो उसे reduced price के साथ prior price भी दिखाना होगा।
Prior price सामान्यतः उस वस्तु अथवा सेवा की पिछले 30 दिनों में platform पर उपलब्ध सबसे कम कीमत होगी।
Prior Price नियम क्यों महत्वपूर्ण है?
इस नियम का उद्देश्य कृत्रिम discount से उपभोक्ताओं को बचाना है। उदाहरण के लिए seller sale से ठीक पहले कीमत बढ़ाकर फिर उसे बड़ी छूट के रूप में प्रस्तुत नहीं कर सकेगा।
30 दिन की reference period उपभोक्ता को वास्तविक तुलना करने का आधार देती है।
Search Ranking Transparency
संशोधित नियम marketplace platforms पर search ranking से संबंधित पारदर्शिता को मजबूत करते हैं।
ऐसे search results में हेरफेर नहीं किया जा सकता जो उपभोक्ता को भ्रमित करे या listing की वास्तविक relevance को अनुचित रूप से प्रभावित करे।
Sponsored Listings
Paid या sponsored listings को स्पष्ट रूप से पहचान योग्य बनाना आवश्यक होगा।
इससे उपभोक्ता सामान्य search result और paid promotion के बीच अंतर समझ सकेगा।
Dark Patterns
नए नियम Guidelines for Prevention and Regulation of Dark Patterns, 2023 के पालन को भी मजबूत करते हैं।
Dark patterns ऐसे deceptive interface designs होते हैं जो उपयोगकर्ता को ऐसी कार्रवाई करने के लिए प्रभावित करते हैं जिसे वह सामान्य रूप से नहीं चुनता। उदाहरण के लिए बिना स्पष्ट अनुमति के उत्पाद जोड़ना, झूठी urgency दिखाना या subscription cancel करना अत्यधिक कठिन बनाना।
Annual Self-Audit
E-commerce entities को dark-pattern compliance से संबंधित वार्षिक self-audit करना होगा और संबंधित compliance certificate को प्रमुखता से प्रदर्शित करना होगा।
इससे digital platforms की आंतरिक जवाबदेही बढ़ेगी।
National Consumer Helpline
E-commerce entities को National Consumer Helpline की convergence process से जुड़ना होगा।
National Consumer Helpline उपभोक्ताओं को शिकायत दर्ज करने और सहायता प्राप्त करने का केंद्रीकृत माध्यम प्रदान करती है।
Grievance Officer
संशोधित व्यवस्था grievance handling को मजबूत करती है। शिकायत दर्ज होने पर उपभोक्ता को शिकायत से संबंधित उचित record उपलब्ध कराया जाना चाहिए।
इससे शिकायत की स्थिति को track करना आसान होगा।
Seller और Product Disclosure
Marketplace entities को seller और product से संबंधित महत्वपूर्ण जानकारी उपलब्ध करानी होगी ताकि उपभोक्ता informed decision ले सके।
आयातित वस्तुओं के मामले में importer और country of origin की जानकारी भी महत्वपूर्ण है।
Consumer Consent
उपभोक्ता की जानकारी के उपयोग से संबंधित मामलों में स्पष्ट और affirmative consent की आवश्यकता को मजबूत किया गया है।
भ्रामक अथवा पहले से चुने गए विकल्पों द्वारा consent प्राप्त करने की प्रवृत्ति को सीमित करना इसका उद्देश्य है।
Consumer Protection Act, 2019
E-Commerce Rules का कानूनी आधार Consumer Protection Act, 2019 है।
इस अधिनियम ने भारत की consumer protection व्यवस्था का आधुनिकीकरण किया और Central Consumer Protection Authority की स्थापना की।
