The United Nations Convention against Cybercrime is a global treaty intended to strengthen cooperation against cybercrime and facilitate the lawful exchange of electronic evidence. The United Nations General Assembly adopted the convention in December 2024.
Why in News?
In November 2025, India's Supreme Court reportedly asked the Union Government to consider its position on the convention in the context of cyber-enabled fraud and digital-arrest scams.
Objectives
The convention seeks to improve international cooperation, establish a common framework for specified cybercrime offences, facilitate electronic-evidence sharing and support technical assistance and capacity-building, particularly for developing countries.
Important Offences
The treaty addresses offences such as illegal access to computer systems, illegal interception, computer-related fraud and certain forms of online child sexual exploitation. It also addresses the non-consensual dissemination of intimate images.
Electronic Evidence
Digital evidence can be stored in another country even when victims and suspects are located elsewhere. The convention establishes procedures for international cooperation concerning electronic evidence, including in investigations of certain serious crimes.
International Cooperation
The treaty provides for cooperation mechanisms, including contact arrangements intended to support timely assistance across borders. Such cooperation must operate within the treaty's conditions and applicable safeguards.
Entry into Force
The convention provides for entry into force on the ninetieth day after the deposit of the fortieth instrument of ratification, acceptance, approval or accession. Adoption by the UN General Assembly is not the same as entry into force.
Human Rights and Privacy
Cross-border evidence-sharing and surveillance powers raise questions about privacy, due process and freedom of expression. These issues are relevant when governments consider implementing legislation and safeguards.

संयुक्त राष्ट्र साइबर अपराध अभिसमय एक वैश्विक संधि है, जिसका उद्देश्य साइबर अपराध के विरुद्ध सहयोग मजबूत करना और इलेक्ट्रॉनिक साक्ष्यों के वैध आदान-प्रदान को सुगम बनाना है। संयुक्त राष्ट्र महासभा ने दिसंबर 2024 में इस अभिसमय को अपनाया।
चर्चा में क्यों?
नवंबर 2025 में साइबर माध्यम से होने वाली धोखाधड़ी और डिजिटल अरेस्ट घोटालों के संदर्भ में भारत के सर्वोच्च न्यायालय द्वारा केंद्र सरकार से अभिसमय पर अपनी स्थिति पर विचार करने के लिए कहे जाने की खबर सामने आई।
उद्देश्य
इस अभिसमय का उद्देश्य अंतरराष्ट्रीय सहयोग सुधारना, निर्धारित साइबर अपराधों के लिए साझा व्यवस्था विकसित करना, इलेक्ट्रॉनिक साक्ष्यों के आदान-प्रदान को सरल बनाना और विशेषकर विकासशील देशों की तकनीकी क्षमता बढ़ाने में सहायता करना है।
प्रमुख अपराध
इसमें कंप्यूटर प्रणाली में अवैध प्रवेश, अवैध अवरोधन, कंप्यूटर से संबंधित धोखाधड़ी और बच्चों के ऑनलाइन यौन शोषण के कुछ रूपों जैसे अपराध शामिल हैं। इसमें सहमति के बिना अंतरंग चित्रों का प्रसार भी संबोधित किया गया है।
इलेक्ट्रॉनिक साक्ष्य
किसी अपराध के पीड़ित और संदिग्ध एक देश में हो सकते हैं, जबकि डिजिटल साक्ष्य दूसरे देश में संग्रहीत हो सकते हैं। यह अभिसमय कुछ गंभीर अपराधों की जाँच सहित इलेक्ट्रॉनिक साक्ष्यों के संबंध में अंतरराष्ट्रीय सहयोग की प्रक्रियाएँ प्रदान करता है।
अंतरराष्ट्रीय सहयोग
संधि में सीमापार समय पर सहायता उपलब्ध कराने के लिए संपर्क व्यवस्थाओं सहित सहयोग के उपाय हैं। ऐसा सहयोग संधि की शर्तों और लागू सुरक्षा प्रावधानों के अधीन होना चाहिए।
प्रभावी होने की शर्त
अभिसमय में प्रावधान है कि अनुसमर्थन, स्वीकृति, अनुमोदन अथवा सम्मिलन का चालीसवाँ दस्तावेज जमा होने के नब्बेवें दिन यह प्रभावी होगा। संयुक्त राष्ट्र महासभा द्वारा अपनाया जाना और संधि का प्रभावी होना अलग-अलग घटनाएँ हैं।
मानवाधिकार और निजता
सीमापार साक्ष्य आदान-प्रदान और निगरानी संबंधी शक्तियों से निजता, उचित कानूनी प्रक्रिया तथा अभिव्यक्ति की स्वतंत्रता के प्रश्न उठते हैं। सरकारों द्वारा क्रियान्वयन कानून और सुरक्षा उपाय तैयार करते समय ये विषय महत्वपूर्ण हैं।
