PART I: ENGLISH

1. Introduction

Federalism is a system of governance in which constitutional authority is distributed between different levels of government. In India, the Constitution establishes a Union government and state governments, each exercising authority within its constitutionally assigned sphere.

Indian federalism combines a division of powers with a relatively strong Union. This arrangement reflects the country's geographical size, social diversity, historical experience, development needs and requirements of national coordination.

Federalism in India is not merely an administrative arrangement. It provides a constitutional framework for accommodating linguistic, cultural, regional and economic diversity while maintaining political unity.

For UPSC GS Paper 2, federalism should be studied through constitutional provisions, institutions, fiscal arrangements, political practices and practical governance challenges.

2. What Is Federalism?

Federalism involves the constitutional distribution of powers between a central authority and constituent units. Both levels derive their authority from the Constitution rather than from an ordinary law passed by the other level.

Important characteristics of a federal system generally include a written Constitution, distribution of legislative and executive powers, constitutional supremacy, mechanisms for resolving disputes and an independent judiciary.

However, federal systems differ considerably. Some place greater emphasis on the autonomy of constituent units, while others give the central authority substantial powers to coordinate national affairs.

3. Is India Federal or Unitary?

Article 1 describes India as a Union of States. The Constitution creates a federal distribution of powers, but it also contains provisions that strengthen the Union.

India is therefore commonly described in constitutional scholarship as a federation with a strong Centre or a system with both federal and unitary features.

The Supreme Court has recognised federalism as part of the Constitution's basic structure. This means that the constitutional distribution of power cannot be destroyed through an ordinary exercise of the constitutional amendment power.

3.1 Federal Features

  • Constitutional distribution of legislative powers.
  • Union and state governments with constitutionally assigned responsibilities.
  • Written and supreme Constitution.
  • Independent judiciary and constitutional adjudication.
  • Rajya Sabha as the Council of States.

3.2 Features Strengthening the Union

Analytical point: The existence of a strong Union does not mean that states lack constitutional authority. Indian federalism must be understood as an integrated constitutional system containing both autonomy and coordination.

4. Distribution of Legislative Powers

Article 246, read with the Seventh Schedule, establishes the principal distribution of legislative subjects between Parliament and state legislatures.

4.1 Union List

The Union List includes subjects requiring substantial national coordination, such as defence, foreign affairs, currency and railways. Parliament ordinarily has exclusive power to legislate on these subjects.

4.2 State List

The State List includes subjects such as public order, police, public health and agriculture. State legislatures ordinarily exercise legislative authority over these matters, subject to constitutional exceptions.

4.3 Concurrent List

The Concurrent List includes subjects on which both Parliament and state legislatures may legislate, such as education, forests, marriage and certain aspects of criminal law.

Where a state law conflicts with a valid parliamentary law on a Concurrent List matter, Article 254 generally gives priority to the parliamentary law. A state law reserved for and receiving presidential assent may prevail in that state in specified circumstances, although Parliament can subsequently override it.

4.4 Residuary Powers

Under Article 248 and the relevant entry in the Union List, Parliament has residuary legislative authority over matters not enumerated in the State or Concurrent Lists, subject to the Constitution's specific arrangements.

5. When Can Parliament Legislate on State List Subjects?

The normal distribution of powers is subject to carefully specified constitutional exceptions.

These provisions demonstrate that India's distribution of powers is constitutionally structured but not completely rigid.

6. Administrative Relations Between the Union and States

Legislative authority and administrative responsibility are closely connected. Part XI of the Constitution also addresses administrative relations between the Union and states.

Article 256 requires the executive power of every state to be exercised so as to ensure compliance with laws made by Parliament and applicable existing laws. It also permits the Union to issue directions for that purpose.

Article 257 addresses the exercise of state executive power in relation to the Union's executive authority and contains provisions concerning certain directions.

Articles 258 and 258A provide mechanisms for the entrustment of functions between the Union and states, subject to their respective constitutional conditions.

Governance significance: Many public programmes require Union financing, state implementation and local delivery. Effective administration therefore depends on coordination rather than constitutional powers alone.

7. Cooperative Federalism

Cooperative federalism refers to an approach in which different levels of government work together to address common challenges while respecting their constitutional roles.

It is especially important where policy areas overlap or where national objectives depend on state-level implementation.

Examples include disaster management, public health, education, environmental protection, infrastructure development and the management of inter-state rivers.

7.1 Important Elements

  • Regular consultation between the Union and states.
  • Joint planning and coordinated implementation.
  • Predictable and transparent financial arrangements.
  • Respect for state-specific conditions.
  • Sharing of administrative information and successful practices.
  • Institutional mechanisms for resolving disagreements.

Cooperation does not require the absence of disagreement. A functioning federation needs legitimate channels through which different governments can express and resolve competing interests.

8. Competitive Federalism

Competitive federalism refers to competition among states to improve governance, attract investment, develop infrastructure and deliver public services.

States may experiment with different policies and learn from one another's experiences. Competition can encourage innovation and administrative improvement.

However, competition may produce unequal outcomes where states begin with different levels of income, infrastructure, administrative capacity and geographical advantages.

It may also create incentives to prioritise easily measurable indicators while neglecting difficult social outcomes.

Balanced understanding: Cooperative and competitive federalism are not mutually exclusive. States can compete in innovation while cooperating on shared environmental, economic and social challenges.

9. Fiscal Federalism

Fiscal federalism concerns the distribution of revenue-raising powers, expenditure responsibilities and financial transfers among different levels of government.

In India, the Union and states have different taxation powers and spending obligations. The Union has access to several major revenue sources, while states bear substantial responsibilities for public services such as health, education and local infrastructure.

This can create a vertical fiscal imbalance: the distribution of revenue does not necessarily match the distribution of expenditure responsibilities.

There are also horizontal fiscal imbalances because states differ in population, income, geography, revenue capacity and development needs.

9.1 Vertical Fiscal Imbalance

A vertical imbalance arises when one level of government has greater revenue capacity relative to its expenditure obligations than another level.

9.2 Horizontal Fiscal Imbalance

A horizontal imbalance arises when governments at the same level possess different fiscal capacities or expenditure needs.

Financial transfers seek to address these imbalances while maintaining incentives for sound public financial management.

10. Finance Commission

Article 280 provides for the constitution of a Finance Commission by the President at the prescribed intervals or earlier when considered necessary.

The Commission makes recommendations concerning the distribution of the net proceeds of specified taxes between the Union and states, the allocation of states' shares among states, and principles governing certain grants-in-aid.

Its constitutional functions also include recommending measures to augment the Consolidated Fund of a state to supplement resources of panchayats and municipalities on the basis of state Finance Commission recommendations.

The Finance Commission is an important institution for fiscal coordination, equalisation and financial accountability.

11. Tax Devolution, Grants and Borrowing

Tax devolution involves distributing the states' share of divisible Union tax proceeds according to the applicable constitutional and institutional framework.

Grants-in-aid can support states with particular needs and expenditure responsibilities. Article 275 provides for certain grants from the Union to states, while Article 282 permits grants for public purposes within its constitutional scope.

Borrowing also forms part of fiscal federalism. Article 293 governs state borrowing and provides for Union consent in specified circumstances where a state remains indebted to the Union or where a Union guarantee is outstanding.

Fiscal autonomy must be examined alongside debt sustainability, transparency and the ability of governments to finance essential public services.

12. GST and the GST Council

The Goods and Services Tax represents an important restructuring of India's indirect taxation system. It involves both Union and state governments in a shared constitutional framework.

Article 246A provides special legislative powers concerning GST. Article 269A addresses GST on supplies in the course of inter-state trade or commerce. Article 279A provides for the GST Council.

The GST Council brings together representatives of the Union and states and makes recommendations on specified GST matters.

Its constitutional voting arrangement assigns one-third of the weighted votes to the Union government's representatives and two-thirds to the representatives of all state governments taken together. Decisions at a meeting require the prescribed three-fourths majority of weighted votes of members present and voting.

The Supreme Court has explained that GST Council recommendations generally have persuasive value rather than automatically binding legislative force. The constitutional and statutory provisions applicable to a particular issue must still be examined.

UPSC analytical point: The GST framework illustrates the need to combine a common national market with the fiscal interests and constitutional role of states.

13. Inter-State Council

Article 263 permits the President to establish an Inter-State Council when it appears that the public interest would be served by doing so.

The constitutional functions that may be assigned include inquiry into and advice upon disputes between states, discussion of subjects of common interest, and recommendations for better coordination of policy and action.

The Inter-State Council provides a forum for political and administrative dialogue. It is distinct from the Supreme Court's judicial jurisdiction over specified disputes.

Its effectiveness depends on regular engagement, preparation, follow-up and the willingness of participating governments to address shared concerns.

14. Zonal Councils

Zonal Councils are statutory bodies established under the States Reorganisation Act, 1956. They facilitate cooperation among states and Union territories within their respective zones.

They provide forums for discussing regional matters such as infrastructure, transport, border-related issues and inter-state coordination.

Prelims distinction: The Inter-State Council has its constitutional basis in Article 263, whereas Zonal Councils are statutory institutions.

15. Inter-State River Water Disputes

River basins often cross state boundaries. Upstream and downstream states may have different requirements concerning irrigation, drinking water, hydropower, environmental flows and flood control.

Article 262 permits Parliament to provide by law for adjudication of disputes or complaints concerning the use, distribution or control of waters of inter-state rivers or river valleys. It also permits Parliament to exclude the jurisdiction of the Supreme Court and other courts over such disputes to the extent provided by law.

The Inter-State River Water Disputes Act, 1956 establishes a statutory framework for adjudicating covered disputes.

However, legal adjudication alone may not address every basin-management problem. Effective solutions also require reliable data, demand management, environmental protection, coordinated reservoir operations and sustained dialogue.

16. Original Jurisdiction of the Supreme Court

Article 131 provides the Supreme Court with original jurisdiction over specified disputes involving the Government of India and states, or states among themselves, where the dispute involves a question on which the existence or extent of a legal right depends.

This jurisdiction is subject to the Constitution's provisions and applicable exclusions. Not every political disagreement between governments automatically becomes a dispute maintainable under Article 131.

The distinction between political negotiation, statutory dispute-resolution mechanisms and judicial adjudication is important for understanding federal governance.

17. Role of the Governor in Centre–State Relations

The Governor is the constitutional head of a state and is appointed by the President under Article 155. The office connects several constitutional processes involving the state executive, legislature and Union.

Areas of recurring constitutional discussion include government formation, the summoning of the legislature, the handling of bills and reports concerning constitutional governance.

Article 200 deals with the Governor's options concerning bills presented after passage by the state legislature, while Article 201 concerns bills reserved for the President's consideration.

Questions concerning the Governor's role must be assessed using the Constitution and relevant judicial decisions rather than assumptions that the office possesses unlimited discretion.

18. President's Rule and Federalism

Article 356 provides for a Proclamation where the President is satisfied, on receipt of a Governor's report or otherwise, that the government of a state cannot be carried on in accordance with the Constitution.

Because this provision can significantly alter normal state governance, constitutional safeguards and judicial review are important.

In S. R. Bommai v. Union of India, the Supreme Court established important principles concerning judicial review of proclamations under Article 356 and the constitutional significance of federalism.

Key principle: A disagreement between the Union and a state government does not, by itself, establish that constitutional government in the state has become impossible.

19. Local Government and the Third Tier

Indian federalism is often discussed in terms of the Union and states, but local self-government is essential for democratic decentralisation.

The 73rd and 74th Constitutional Amendments provided constitutional recognition to panchayats and municipalities through Parts IX and IXA of the Constitution.

The Eleventh and Twelfth Schedules identify subjects relevant to rural and urban local government respectively. Actual devolution of functions and responsibilities depends on the applicable constitutional and state legislative framework.

Effective local governance requires the transfer of functions, funds and functionaries, supported by administrative capacity and public accountability.

A federation cannot fully realise the benefits of decentralisation if decisions remain excessively concentrated above the level where public services are delivered.

20. Major Challenges to Indian Federalism

20.1 Fiscal Dependence

States may face expenditure pressures while depending on tax transfers, grants and borrowing arrangements. Uncertainty over resources can complicate long-term planning.

20.2 Unequal Development

States differ substantially in infrastructure, industrialisation, human development, geographical constraints and administrative capacity.

20.3 Overlapping Responsibilities

Public health, education, environmental protection and disaster management require coordination across multiple institutions. Unclear responsibilities may produce delays or accountability gaps.

20.4 Inter-State Disputes

River-water allocation, territorial questions, transport arrangements and other regional matters may require sustained negotiation or legal resolution.

20.5 Institutional Coordination

Consultative bodies cannot achieve their purpose through formal existence alone. Regular meetings, transparent information and implementation of agreed actions are important.

20.6 Weak Local Capacity

Insufficient staff, financial resources and administrative autonomy can limit the ability of panchayats and municipalities to deliver services effectively.

21. Federalism and Disaster Management: An Applied Example

Consider a severe flood affecting two neighbouring states. Rivers, transport routes and displaced populations cross administrative boundaries.

The Union may provide national-level coordination, financial assistance and specialised resources. State governments manage many operational responsibilities, while district administrations and local bodies organise evacuation, shelters, relief and restoration of essential services.

If each institution works independently, relief may be delayed and resources duplicated. Cooperative federalism improves outcomes through shared forecasts, interoperable information, coordinated reservoir management and clear operational responsibilities.

This example demonstrates that constitutional division of powers and practical cooperation must operate together.

22. How Can Indian Federalism Be Strengthened?

  1. Institutional dialogue: Encourage regular and substantive engagement through constitutionally and statutorily established forums.
  2. Fiscal predictability: Improve transparency and timely information concerning transfers, grants and expenditure responsibilities.
  3. Respect for constitutional roles: Exercise Union and state powers according to the Constitution and applicable judicial decisions.
  4. Evidence-based coordination: Share reliable data for river basins, public health, infrastructure and disaster risks.
  5. Local decentralisation: Strengthen the financial and administrative capacity of panchayats and municipalities.
  6. Dispute resolution: Use consultation, negotiation, statutory processes and judicial mechanisms as appropriate.
  7. Policy learning: Encourage states to exchange successful administrative practices without ignoring differences in starting conditions.

4.4 अवशिष्ट शक्तियाँ

अनुच्छेद 248 और संघ सूची की संबंधित प्रविष्टि के अंतर्गत राज्य या समवर्ती सूची में वर्णित नहीं किए गए विषयों पर, संविधान की विशिष्ट व्यवस्थाओं के अधीन, संसद को अवशिष्ट विधायी अधिकार प्राप्त है।

5. संसद राज्य सूची के विषयों पर कब कानून बना सकती है?

शक्तियों का सामान्य वितरण सावधानीपूर्वक निर्धारित संवैधानिक अपवादों के अधीन है।

अनुच्छेद 252दो या अधिक राज्य राज्य सूची के विषय पर संसदीय कानून के लिए सहमति देते हैं और अन्य राज्य बाद में उसे अपना सकते हैं।
अनुच्छेद 253संसद संधियों, समझौतों या अंतरराष्ट्रीय निर्णयों को लागू करने के लिए कानून बना सकती है।
अनुच्छेद 356 के साथ अनुच्छेद 357राष्ट्रपति शासन के दौरान विशेष विधायी व्यवस्थाएँ लागू हो सकती हैं।

ये प्रावधान दर्शाते हैं कि भारत में शक्तियों का वितरण संवैधानिक रूप से निर्धारित है, लेकिन पूरी तरह कठोर नहीं है।

6. संघ और राज्यों के बीच प्रशासनिक संबंध

विधायी अधिकार और प्रशासनिक जिम्मेदारियाँ एक-दूसरे से निकटता से जुड़ी हैं। संविधान का भाग 11 संघ और राज्यों के बीच प्रशासनिक संबंधों को भी संबोधित करता है।

अनुच्छेद 256 के अनुसार प्रत्येक राज्य की कार्यपालिका शक्ति का प्रयोग इस प्रकार किया जाना चाहिए कि संसद द्वारा बनाए गए कानूनों और लागू विद्यमान कानूनों का पालन सुनिश्चित हो। यह संघ को इस उद्देश्य से निर्देश देने की अनुमति भी देता है।

अनुच्छेद 257 संघ की कार्यपालिका शक्ति के संबंध में राज्य की कार्यपालिका शक्ति के प्रयोग को संबोधित करता है और कुछ निर्देशों से संबंधित प्रावधान रखता है।

अनुच्छेद 258 और 258क अपनी-अपनी संवैधानिक शर्तों के अधीन संघ और राज्यों के बीच कार्य सौंपने की व्यवस्था प्रदान करते हैं।

शासन संबंधी महत्व: अनेक सार्वजनिक कार्यक्रमों के लिए संघीय वित्तपोषण, राज्य स्तरीय कार्यान्वयन और स्थानीय स्तर पर सेवाओं की उपलब्धता आवश्यक होती है। इसलिए प्रभावी प्रशासन केवल संवैधानिक अधिकारों पर नहीं, बल्कि समन्वय पर भी निर्भर करता है।

7. सहकारी संघवाद

सहकारी संघवाद वह दृष्टिकोण है जिसमें सरकारों के विभिन्न स्तर अपनी संवैधानिक भूमिकाओं का सम्मान करते हुए साझा चुनौतियों का समाधान करने के लिए मिलकर कार्य करते हैं।

यह विशेष रूप से उन नीति क्षेत्रों में महत्वपूर्ण है जहाँ जिम्मेदारियाँ एक-दूसरे से जुड़ी होती हैं या राष्ट्रीय उद्देश्यों की प्राप्ति राज्य स्तरीय कार्यान्वयन पर निर्भर करती है।

इसके उदाहरणों में आपदा प्रबंधन, लोक स्वास्थ्य, शिक्षा, पर्यावरण संरक्षण, आधारभूत संरचना विकास और अंतरराज्यीय नदियों का प्रबंधन शामिल हैं।

7.1 महत्वपूर्ण तत्व

  • संघ और राज्यों के बीच नियमित परामर्श।
  • संयुक्त योजना और समन्वित कार्यान्वयन।
  • पूर्वानुमेय और पारदर्शी वित्तीय व्यवस्थाएँ।
  • राज्य-विशिष्ट परिस्थितियों का सम्मान।
  • प्रशासनिक जानकारी और सफल कार्यप्रणालियों का आदान-प्रदान।
  • मतभेदों के समाधान के लिए संस्थागत व्यवस्थाएँ।

सहयोग का अर्थ मतभेदों का अभाव नहीं है। प्रभावी संघीय व्यवस्था में ऐसे वैध माध्यम आवश्यक हैं जिनसे विभिन्न सरकारें अपने हित व्यक्त कर सकें और विवादों का समाधान कर सकें।

8. प्रतिस्पर्धी संघवाद

प्रतिस्पर्धी संघवाद से आशय राज्यों के बीच शासन सुधारने, निवेश आकर्षित करने, आधारभूत संरचना विकसित करने और सार्वजनिक सेवाओं की गुणवत्ता बढ़ाने की प्रतिस्पर्धा से है।

राज्य अलग-अलग नीतियों का प्रयोग कर सकते हैं और एक-दूसरे के अनुभवों से सीख सकते हैं। प्रतिस्पर्धा नवाचार और प्रशासनिक सुधार को प्रोत्साहित कर सकती है।

हालाँकि जहाँ राज्यों की प्रारंभिक आय, आधारभूत संरचना, प्रशासनिक क्षमता और भौगोलिक लाभ अलग हों, वहाँ प्रतिस्पर्धा असमान परिणाम उत्पन्न कर सकती है।

यह कठिन सामाजिक परिणामों की उपेक्षा करके आसानी से मापे जा सकने वाले संकेतकों को प्राथमिकता देने के प्रोत्साहन भी उत्पन्न कर सकती है।

संतुलित समझ: सहकारी और प्रतिस्पर्धी संघवाद एक-दूसरे के विरोधी नहीं हैं। राज्य नवाचार में प्रतिस्पर्धा करते हुए साझा पर्यावरणीय, आर्थिक और सामाजिक चुनौतियों पर सहयोग कर सकते हैं।

9. राजकोषीय संघवाद

राजकोषीय संघवाद सरकारों के विभिन्न स्तरों के बीच राजस्व जुटाने की शक्तियों, व्यय संबंधी जिम्मेदारियों और वित्तीय हस्तांतरण के वितरण से संबंधित है।

भारत में संघ और राज्यों की कराधान शक्तियाँ तथा व्यय संबंधी जिम्मेदारियाँ अलग-अलग हैं। संघ के पास कई प्रमुख राजस्व स्रोत हैं, जबकि राज्यों पर स्वास्थ्य, शिक्षा और स्थानीय आधारभूत संरचना जैसी सार्वजनिक सेवाओं की पर्याप्त जिम्मेदारियाँ हैं।

इससे ऊर्ध्वाधर राजकोषीय असंतुलन उत्पन्न हो सकता है, जिसमें राजस्व का वितरण व्यय संबंधी जिम्मेदारियों के वितरण से मेल नहीं खाता।

क्षैतिज राजकोषीय असंतुलन भी होता है क्योंकि राज्यों की जनसंख्या, आय, भूगोल, राजस्व क्षमता और विकास संबंधी आवश्यकताएँ अलग-अलग हैं।

9.1 ऊर्ध्वाधर राजकोषीय असंतुलन

ऊर्ध्वाधर असंतुलन तब उत्पन्न होता है जब सरकार के एक स्तर की राजस्व क्षमता उसकी व्यय जिम्मेदारियों की तुलना में दूसरे स्तर से अधिक होती है।

9.2 क्षैतिज राजकोषीय असंतुलन

क्षैतिज असंतुलन तब उत्पन्न होता है जब समान स्तर की सरकारों की राजकोषीय क्षमता या व्यय संबंधी आवश्यकताएँ अलग-अलग होती हैं।

वित्तीय हस्तांतरण इन असंतुलनों को कम करने का प्रयास करते हैं, साथ ही जिम्मेदार सार्वजनिक वित्त प्रबंधन के प्रोत्साहनों को बनाए रखते हैं।

10. वित्त आयोग

अनुच्छेद 280 राष्ट्रपति द्वारा निर्धारित अंतराल पर अथवा आवश्यक समझे जाने पर उससे पहले वित्त आयोग के गठन का प्रावधान करता है।

आयोग निर्दिष्ट करों की शुद्ध प्राप्तियों के संघ और राज्यों के बीच वितरण, राज्यों के हिस्से के राज्यों के बीच आवंटन तथा कुछ सहायता अनुदानों के सिद्धांतों के संबंध में सिफारिशें करता है।

इसके संवैधानिक कार्यों में राज्य वित्त आयोगों की सिफारिशों के आधार पर पंचायतों और नगरपालिकाओं के संसाधनों की पूर्ति के लिए राज्य की संचित निधि बढ़ाने के उपायों की सिफारिश करना भी शामिल है।

वित्त आयोग राजकोषीय समन्वय, वित्तीय असमानता कम करने और वित्तीय जवाबदेही के लिए महत्वपूर्ण संस्था है।

11. कर हस्तांतरण, अनुदान और उधारी

कर हस्तांतरण में लागू संवैधानिक और संस्थागत व्यवस्था के अनुसार विभाज्य संघीय कर प्राप्तियों में राज्यों के हिस्से का वितरण शामिल होता है।

सहायता अनुदान विशेष आवश्यकताओं और व्यय जिम्मेदारियों वाले राज्यों की सहायता कर सकते हैं। अनुच्छेद 275 संघ से राज्यों को कुछ अनुदानों का प्रावधान करता है, जबकि अनुच्छेद 282 अपने संवैधानिक दायरे में सार्वजनिक उद्देश्यों के लिए अनुदान की अनुमति देता है।

उधारी भी राजकोषीय संघवाद का हिस्सा है। अनुच्छेद 293 राज्यों की उधारी को नियंत्रित करता है और निर्दिष्ट परिस्थितियों में संघ की सहमति का प्रावधान करता है, जब कोई राज्य संघ का ऋणी बना हुआ हो या संघ की गारंटी बकाया हो।

राजकोषीय स्वायत्तता का अध्ययन ऋण की स्थिरता, पारदर्शिता और आवश्यक सार्वजनिक सेवाओं के वित्तपोषण की क्षमता के साथ करना चाहिए।

12. जीएसटी और जीएसटी परिषद

वस्तु एवं सेवा कर भारत की अप्रत्यक्ष कर प्रणाली के महत्वपूर्ण पुनर्गठन का प्रतिनिधित्व करता है। इसमें संघ और राज्य सरकारें साझा संवैधानिक ढाँचे में शामिल हैं।

अनुच्छेद 246क जीएसटी से संबंधित विशेष विधायी शक्तियाँ प्रदान करता है। अनुच्छेद 269क अंतरराज्यीय व्यापार या वाणिज्य के दौरान आपूर्ति पर जीएसटी से संबंधित है। अनुच्छेद 279क जीएसटी परिषद का प्रावधान करता है।

जीएसटी परिषद संघ और राज्यों के प्रतिनिधियों को एक साथ लाती है तथा निर्दिष्ट जीएसटी मामलों पर सिफारिशें करती है।

इसकी संवैधानिक मतदान व्यवस्था में संघ सरकार के प्रतिनिधियों को कुल भारित मतों का एक-तिहाई और सभी राज्य सरकारों के प्रतिनिधियों को मिलाकर दो-तिहाई भारित मत प्राप्त होते हैं। किसी बैठक में निर्णय के लिए उपस्थित और मतदान करने वाले सदस्यों के भारित मतों का निर्धारित तीन-चौथाई बहुमत आवश्यक है।

उच्चतम न्यायालय ने स्पष्ट किया है कि जीएसटी परिषद की सिफारिशों का सामान्यतः प्रेरक महत्व है; वे अपने आप प्रत्येक स्थिति में बाध्यकारी विधायी शक्ति नहीं रखतीं। किसी विशेष विषय पर लागू संवैधानिक और वैधानिक प्रावधानों का परीक्षण आवश्यक है।

मुख्य परीक्षा का विश्लेषणात्मक बिंदु: जीएसटी व्यवस्था साझा राष्ट्रीय बाजार को राज्यों के राजकोषीय हितों और संवैधानिक भूमिका के साथ जोड़ने की आवश्यकता दर्शाती है।

13. अंतरराज्यीय परिषद

अनुच्छेद 263 राष्ट्रपति को अंतरराज्यीय परिषद स्थापित करने की अनुमति देता है, यदि ऐसा करना लोकहित में आवश्यक प्रतीत हो।

इसके अंतर्गत सौंपे जा सकने वाले संवैधानिक कार्यों में राज्यों के बीच विवादों की जाँच और उन पर सलाह, साझा हित के विषयों पर चर्चा तथा नीति और कार्रवाई के बेहतर समन्वय के लिए सिफारिशें शामिल हैं।

अंतरराज्यीय परिषद राजनीतिक और प्रशासनिक संवाद का मंच प्रदान करती है। यह निर्दिष्ट विवादों पर उच्चतम न्यायालय के न्यायिक क्षेत्राधिकार से अलग है।

इसकी प्रभावशीलता नियमित सहभागिता, तैयारी, अनुवर्ती कार्रवाई और साझा चिंताओं के समाधान के लिए भागीदार सरकारों की तत्परता पर निर्भर करती है।

14. क्षेत्रीय परिषदें

क्षेत्रीय परिषदें राज्य पुनर्गठन अधिनियम, 1956 के अंतर्गत स्थापित वैधानिक संस्थाएँ हैं। ये अपने-अपने क्षेत्रों के राज्यों और संघ राज्य क्षेत्रों के बीच सहयोग को सुविधाजनक बनाती हैं।

ये आधारभूत संरचना, परिवहन, सीमा संबंधी मुद्दों और अंतरराज्यीय समन्वय जैसे क्षेत्रीय विषयों पर चर्चा के मंच प्रदान करती हैं।

प्रारंभिक परीक्षा के लिए अंतर: अंतरराज्यीय परिषद का संवैधानिक आधार अनुच्छेद 263 है, जबकि क्षेत्रीय परिषदें वैधानिक संस्थाएँ हैं।

15. अंतरराज्यीय नदी जल विवाद

नदी बेसिन प्रायः राज्य सीमाओं को पार करते हैं। ऊपरी और निचले प्रवाह वाले राज्यों की सिंचाई, पेयजल, जलविद्युत, पर्यावरणीय प्रवाह और बाढ़ नियंत्रण संबंधी आवश्यकताएँ अलग हो सकती हैं।

अनुच्छेद 262 संसद को अंतरराज्यीय नदियों या नदी घाटियों के जल के उपयोग, वितरण या नियंत्रण से संबंधित विवादों अथवा शिकायतों के निर्णय के लिए कानून बनाने की अनुमति देता है। यह संसद को कानून द्वारा निर्धारित सीमा तक ऐसे विवादों पर उच्चतम न्यायालय और अन्य न्यायालयों के क्षेत्राधिकार को बाहर करने की अनुमति भी देता है।

अंतरराज्यीय नदी जल विवाद अधिनियम, 1956 इसके अंतर्गत आने वाले विवादों के निर्णय के लिए वैधानिक ढाँचा स्थापित करता है।

हालाँकि केवल कानूनी निर्णय नदी बेसिन प्रबंधन की प्रत्येक समस्या का समाधान नहीं कर सकता। प्रभावी समाधान के लिए विश्वसनीय आँकड़े, माँग प्रबंधन, पर्यावरण संरक्षण, समन्वित जलाशय संचालन और निरंतर संवाद भी आवश्यक हैं।

16. उच्चतम न्यायालय का मूल क्षेत्राधिकार

अनुच्छेद 131 भारत सरकार और राज्यों के बीच अथवा राज्यों के आपसी निर्दिष्ट विवादों पर उच्चतम न्यायालय को मूल क्षेत्राधिकार प्रदान करता है, जहाँ विवाद किसी विधिक अधिकार के अस्तित्व या विस्तार से संबंधित प्रश्न को शामिल करता हो।

यह क्षेत्राधिकार संविधान के प्रावधानों और लागू अपवादों के अधीन है। सरकारों के बीच प्रत्येक राजनीतिक मतभेद अपने आप अनुच्छेद 131 के अंतर्गत विचारणीय विवाद नहीं बन जाता।

संघीय शासन को समझने के लिए राजनीतिक वार्ता, वैधानिक विवाद समाधान और न्यायिक निर्णय के बीच अंतर महत्वपूर्ण है।

17. संघ–राज्य संबंधों में राज्यपाल की भूमिका

राज्यपाल राज्य का संवैधानिक प्रमुख होता है और अनुच्छेद 155 के अंतर्गत उसकी नियुक्ति राष्ट्रपति करते हैं। यह पद राज्य कार्यपालिका, विधानमंडल और संघ से संबंधित अनेक संवैधानिक प्रक्रियाओं से जुड़ा है।

संवैधानिक चर्चा के प्रमुख क्षेत्रों में सरकार का गठन, विधानमंडल का आह्वान, विधेयकों का निपटान और संवैधानिक शासन से संबंधित प्रतिवेदन शामिल हैं।

अनुच्छेद 200 राज्य विधानमंडल द्वारा पारित विधेयकों के प्रस्तुत होने पर राज्यपाल के संवैधानिक विकल्पों से संबंधित है, जबकि अनुच्छेद 201 राष्ट्रपति के विचार के लिए सुरक्षित विधेयकों से संबंधित है।

राज्यपाल की भूमिका से जुड़े प्रश्नों का आकलन संविधान और संबंधित न्यायिक निर्णयों के आधार पर होना चाहिए, न कि इस धारणा पर कि इस पद के पास असीमित विवेकाधिकार हैं।

18. राष्ट्रपति शासन और संघवाद

अनुच्छेद 356 ऐसी स्थिति में उद्घोषणा का प्रावधान करता है जब राष्ट्रपति राज्यपाल के प्रतिवेदन से या अन्यथा संतुष्ट हों कि किसी राज्य की सरकार संविधान के अनुसार नहीं चलाई जा सकती।

चूँकि यह प्रावधान राज्य के सामान्य शासन को महत्वपूर्ण रूप से बदल सकता है, इसलिए संवैधानिक सुरक्षा और न्यायिक समीक्षा महत्वपूर्ण हैं।

एस. आर. बोम्मई बनाम भारत संघ मामले में उच्चतम न्यायालय ने अनुच्छेद 356 के अंतर्गत उद्घोषणाओं की न्यायिक समीक्षा और संघवाद के संवैधानिक महत्व से संबंधित महत्वपूर्ण सिद्धांत स्थापित किए।

मुख्य सिद्धांत: संघ और राज्य सरकार के बीच मतभेद अपने आप यह स्थापित नहीं करता कि राज्य में संवैधानिक शासन चलाना असंभव हो गया है।

19. स्थानीय शासन और तीसरा स्तर

भारतीय संघवाद की चर्चा प्रायः संघ और राज्यों के संदर्भ में होती है, लेकिन लोकतांत्रिक विकेंद्रीकरण के लिए स्थानीय स्वशासन आवश्यक है।

73वें और 74वें संविधान संशोधनों ने संविधान के भाग 9 और भाग 9क के माध्यम से पंचायतों और नगरपालिकाओं को संवैधानिक मान्यता प्रदान की।

ग्यारहवीं और बारहवीं अनुसूचियाँ क्रमशः ग्रामीण और शहरी स्थानीय शासन से संबंधित विषयों की पहचान करती हैं। कार्यों और जिम्मेदारियों का वास्तविक हस्तांतरण लागू संवैधानिक तथा राज्य विधायी ढाँचे पर निर्भर करता है।

प्रभावी स्थानीय शासन के लिए कार्यों, वित्तीय संसाधनों और कर्मचारियों का हस्तांतरण आवश्यक है, जिसे प्रशासनिक क्षमता और सार्वजनिक जवाबदेही का समर्थन प्राप्त हो।

यदि निर्णय उन स्तरों से बहुत ऊपर केंद्रित रहें जहाँ सार्वजनिक सेवाएँ वास्तव में उपलब्ध कराई जाती हैं, तो संघीय व्यवस्था विकेंद्रीकरण के लाभों को पूरी तरह प्राप्त नहीं कर सकती।

20. भारतीय संघवाद की प्रमुख चुनौतियाँ

20.1 राजकोषीय निर्भरता

राज्यों को व्यय संबंधी दबावों का सामना करना पड़ सकता है, जबकि वे कर हस्तांतरण, अनुदान और उधारी व्यवस्थाओं पर निर्भर होते हैं। संसाधनों की अनिश्चितता दीर्घकालीन योजना को कठिन बना सकती है।

20.2 असमान विकास

राज्यों की आधारभूत संरचना, औद्योगीकरण, मानव विकास, भौगोलिक सीमाएँ और प्रशासनिक क्षमता काफी अलग-अलग हैं।

20.3 परस्पर जुड़ी जिम्मेदारियाँ

लोक स्वास्थ्य, शिक्षा, पर्यावरण संरक्षण और आपदा प्रबंधन में अनेक संस्थाओं के बीच समन्वय आवश्यक है। जिम्मेदारियों की अस्पष्टता देरी या जवाबदेही की कमी उत्पन्न कर सकती है।

20.4 अंतरराज्यीय विवाद

नदी जल आवंटन, क्षेत्रीय प्रश्न, परिवहन व्यवस्थाएँ और अन्य क्षेत्रीय मामलों में निरंतर वार्ता या कानूनी समाधान आवश्यक हो सकता है।

20.5 संस्थागत समन्वय

केवल परामर्श संस्थाओं का औपचारिक अस्तित्व उनके उद्देश्य की प्राप्ति के लिए पर्याप्त नहीं है। नियमित बैठकें, पारदर्शी जानकारी और सहमत कार्रवाइयों का कार्यान्वयन महत्वपूर्ण हैं।

20.6 कमजोर स्थानीय क्षमता

अपर्याप्त कर्मचारी, वित्तीय संसाधन और प्रशासनिक स्वायत्तता पंचायतों तथा नगरपालिकाओं की प्रभावी सेवा वितरण क्षमता सीमित कर सकते हैं।

21. संघवाद और आपदा प्रबंधन: एक व्यावहारिक उदाहरण

कल्पना कीजिए कि दो पड़ोसी राज्यों में गंभीर बाढ़ आई है। नदियाँ, परिवहन मार्ग और विस्थापित आबादी प्रशासनिक सीमाओं को पार कर रहे हैं।

संघ राष्ट्रीय स्तर का समन्वय, वित्तीय सहायता और विशेष संसाधन प्रदान कर सकता है। राज्य सरकारें अनेक परिचालन जिम्मेदारियाँ संभालती हैं, जबकि जिला प्रशासन और स्थानीय निकाय निकासी, आश्रय, राहत तथा आवश्यक सेवाओं की बहाली आयोजित करते हैं।

यदि प्रत्येक संस्था स्वतंत्र रूप से कार्य करे, तो राहत में देरी और संसाधनों का दोहराव हो सकता है। साझा पूर्वानुमान, एक-दूसरे के अनुकूल सूचना प्रणालियाँ, समन्वित जलाशय प्रबंधन और स्पष्ट परिचालन जिम्मेदारियाँ सहकारी संघवाद के माध्यम से परिणाम सुधार सकती हैं।

यह उदाहरण दर्शाता है कि शक्तियों के संवैधानिक विभाजन और व्यावहारिक सहयोग का साथ-साथ कार्य करना आवश्यक है।

22. भारतीय संघवाद को कैसे मजबूत किया जा सकता है?

  1. संस्थागत संवाद: संवैधानिक और वैधानिक मंचों के माध्यम से नियमित तथा सार्थक सहभागिता को प्रोत्साहित करना।
  2. राजकोषीय पूर्वानुमेयता: हस्तांतरण, अनुदान और व्यय जिम्मेदारियों के संबंध में पारदर्शिता तथा समय पर जानकारी में सुधार।
  3. संवैधानिक भूमिकाओं का सम्मान: संघ और राज्य की शक्तियों का प्रयोग संविधान तथा लागू न्यायिक निर्णयों के अनुसार करना।
  4. साक्ष्य-आधारित समन्वय: नदी बेसिन, लोक स्वास्थ्य, आधारभूत संरचना और आपदा जोखिमों से संबंधित विश्वसनीय आँकड़े साझा करना।
  5. स्थानीय विकेंद्रीकरण: पंचायतों और नगरपालिकाओं की वित्तीय तथा प्रशासनिक क्षमता मजबूत करना।
