1. Introduction
Indian federalism is one of the most important themes of Indian Polity for UPSC. India combines a constitutionally divided system of powers with a comparatively strong Union government. The Constitution seeks to preserve national unity while allowing regional governments substantial authority over matters that directly affect their populations. Federalism in India should therefore not be understood merely as a division of subjects between the Union and the States. It is a dynamic system involving legislative powers, administrative coordination, financial transfers, political negotiation, constitutional institutions, judicial interpretation and intergovernmental cooperation.2. Meaning of Federalism
Federalism is a system of government in which constitutional authority is divided between two or more levels of government. Each level derives its authority from the Constitution rather than merely functioning as an administrative agent of another level. A genuine federal arrangement therefore involves constitutionally recognised spheres of authority.3. Essential Features of a Federation
Important features generally associated with a federal system include: 1. Two or more levels of government. 2. A written Constitution. 3. Constitutional division of powers. 4. Supremacy of the Constitution. 5. A relatively rigid constitutional amendment process for federal provisions. 6. An independent judiciary. 7. Mechanisms for resolving disputes between different levels of government. India possesses these features, although the constitutional balance gives substantial strength to the Union.4. Article 1 and the Union of States
Article 1 declares that India, that is Bharat, shall be a Union of States. The Constitution deliberately uses the expression 'Union of States'. This indicates both the federal organisation of the country and the constitutional importance of national unity.5. Why India Is Called a Union of States
The Indian federation was not created through an agreement among previously sovereign States possessing a constitutional right to secede. The Constitution establishes a permanent Union while allowing changes in the territorial organisation of States through constitutional procedures. This makes Indian federalism distinct from classical federations formed through agreements among pre-existing political units.6. Federal and Unitary Features
India possesses both federal and centralising features. Federal features include division of powers, constitutional supremacy, an independent judiciary, bicameralism at the Union level and constitutional participation of States in specified amendments. Centralising features include a strong Union List, residuary powers with Parliament, emergency provisions, Parliament's power to reorganise States and important Union roles in administration and finance.7. India as a Distinctive Federation
Indian federalism should not be forced into a rigid binary of 'federal' or 'unitary'. It has evolved according to India's historical circumstances, territorial diversity, developmental requirements and security concerns. A better description is a constitutionally federal system with significant centralising provisions and strong cooperative mechanisms.8. Federalism and Diversity
India contains immense linguistic, cultural, geographical, economic and social diversity. Federalism allows regional aspirations to be accommodated within a common constitutional framework. It therefore serves not merely an administrative function but also a nation-building function.9. Federalism and Democracy
Federalism disperses political power. Citizens elect governments at multiple levels, thereby creating multiple centres of democratic accountability. This enables different States to adopt policies suited to their circumstances while remaining part of the larger constitutional system.10. Seventh Schedule
The Seventh Schedule distributes legislative subjects between the Union and the States through three lists: 1. Union List. 2. State List. 3. Concurrent List. This distribution is central to legislative federalism.11. Union List
The Union List contains subjects requiring national-level regulation, such as defence, foreign affairs, currency and several matters of national importance. Parliament ordinarily has exclusive legislative competence over subjects in this list.12. State List
The State List contains subjects having strong regional or local dimensions, including public order, police, public health and agriculture, subject to the constitutional scheme. State Legislatures ordinarily legislate on these subjects.13. Concurrent List
Both Parliament and State Legislatures can legislate on subjects in the Concurrent List. The Concurrent List reflects areas where both national coordination and regional legislation may be necessary.14. Article 246
Article 246 provides the basic constitutional distribution of legislative competence among Parliament and State Legislatures with reference to the Seventh Schedule. It must be studied together with the relevant constitutional provisions governing special circumstances.15. Residuary Powers
Article 248 and the constitutional scheme place residuary legislative powers with Parliament. This means matters not enumerated in the State List or Concurrent List fall within Parliament's residuary legislative competence, subject to the Constitution. This is an important distinction from some classical federations where residuary authority belongs to constituent units.16. Parliament and State List — Article 249
Article 249 allows Parliament to legislate on a matter in the State List when the Rajya Sabha passes the constitutionally required resolution declaring that it is necessary or expedient in the national interest. The provision highlights the special federal role of the Council of States.17. Article 250
During a Proclamation of Emergency, Article 250 enables Parliament to legislate with respect to matters in the State List, subject to constitutional conditions. This illustrates the capacity of the Indian federal system to become more centralised during extraordinary situations.18. Article 252
Under Article 252, two or more State Legislatures may consent to Parliament legislating for those States on a State List matter. Other States may subsequently adopt such legislation according to the constitutional mechanism. This is an example of consensual federalism.19. Article 253
Article 253 empowers Parliament to make laws for implementing treaties, agreements, conventions and international decisions, notwithstanding the normal distribution of legislative powers. The provision reflects the Union's responsibility in international relations.20. Repugnancy and Article 254
Article 254 deals principally with inconsistency between Parliamentary and State laws on matters in the Concurrent List. Ordinarily, where valid Union and State laws conflict on a Concurrent List matter, the Parliamentary law prevails to the extent of repugnancy.21. Presidential Assent under Article 254(2)
A State law concerning a Concurrent List matter that is repugnant to an earlier Parliamentary law may, after being reserved for consideration and receiving Presidential assent, prevail within that State. However, Parliament retains constitutional authority to subsequently override such State legislation through legislation.22. Territorial Reorganisation of States
Articles 2 and 3 provide Parliament significant authority concerning admission, establishment and reorganisation of States. Under Article 3, Parliament may form new States or alter areas, boundaries or names according to the constitutional procedure.23. State Consent under Article 3
A common UPSC trap is to assume that consent of the concerned State Legislature is constitutionally mandatory for reorganisation. The President refers the proposal to the concerned State Legislature for expressing its views within the specified period. Those views are not constitutionally binding on Parliament.24. Administrative Relations
Federalism extends beyond legislative powers. The Constitution also regulates administrative relations between the Union and States. Effective implementation of many national and State policies requires continuous administrative cooperation.25. Article 256
Article 256 requires the executive power of every State to ensure compliance with laws made by Parliament and existing laws applicable in that State. It also permits Union directions for this constitutional purpose.26. Article 257
Article 257 provides that the executive power of every State shall be exercised so as not to impede or prejudice the exercise of the executive power of the Union. It also provides for certain Union directions.27. All India Services
All India Services represent a distinctive feature of Indian administrative federalism. Officers serve both Union and State institutions within an integrated administrative framework. They can promote administrative continuity and national standards, although questions concerning accountability and cadre management can generate Centre-State debates.28. Article 312
Article 312 provides the constitutional mechanism for creation of one or more All India Services common to the Union and the States when the Rajya Sabha passes the required resolution in the national interest and Parliament legislates accordingly.29. Inter-State Council
Article 263 provides for the establishment of an Inter-State Council if the President considers that public interests would be served by establishing such a body. Its constitutional functions may include inquiry into and advice upon disputes, discussion of subjects of common interest and recommendations for better policy coordination.30. Cooperative Federalism
Cooperative federalism refers to the Union and States working jointly to address common problems rather than treating their constitutional domains as completely isolated compartments. Public health, infrastructure, environmental protection, disaster management and economic development often require such cooperation.31. Competitive Federalism
Competitive federalism refers to competition among States for investment, infrastructure, human capital, innovation and improved governance. Constructive competition can promote reform, but competition should not undermine equity or cooperative national objectives.32. Cooperative and Competitive Federalism Are Not Opposites
A healthy federation may contain both cooperation and competition. States can cooperate on national objectives while simultaneously competing to improve investment climates, service delivery and innovation.33. NITI Aayog and Federalism
NITI Aayog provides an institutional platform through which the Union and States can discuss developmental strategies and policy priorities. Its Governing Council is associated with the broader idea of cooperative federalism.34. Zonal Councils
Zonal Councils provide forums for interstate consultation and cooperation on issues of common concern. They should not be confused with the Inter-State Council. Their legal and institutional bases are different.35. Fiscal Federalism
Fiscal federalism concerns the constitutional and institutional allocation of taxation powers, expenditure responsibilities, transfers, grants and borrowing among different levels of government. A federation cannot function effectively if responsibilities and financial resources are seriously mismatched.36. Vertical Fiscal Imbalance
Vertical fiscal imbalance arises when the revenue-raising capacity and expenditure responsibilities of different levels of government do not correspond adequately. The Union may collect important taxes while States carry major expenditure responsibilities in areas such as health, agriculture and policing.37. Horizontal Fiscal Imbalance
Horizontal fiscal imbalance refers to differences in fiscal capacity and developmental needs among States. States vary substantially in income, geography, population, infrastructure, demographic characteristics and revenue capacity.38. Finance Commission
Article 280 provides for a Finance Commission constituted by the President. It is a constitutional institution central to fiscal federalism.39. Major Functions of the Finance Commission
The Finance Commission makes recommendations concerning distribution of the divisible pool of taxes between the Union and States and allocation among States. It also addresses grants-in-aid and other matters referred to it under the Constitution. Its role is vital in balancing fiscal capacity with expenditure needs.40. Tax Devolution
Tax devolution transfers a constitutionally determined share of divisible Union tax revenues to States based on Finance Commission recommendations and the constitutional framework. It is different from discretionary scheme-based expenditure.41. Grants-in-Aid
Article 275 provides for grants-in-aid of the revenues of certain States from the Consolidated Fund of India according to the constitutional framework. Grants can help address fiscal gaps and specific developmental requirements.42. GST and Indian Federalism
The Goods and Services Tax significantly transformed India's indirect tax federalism by integrating several Union and State indirect taxes into a shared framework. It requires extensive intergovernmental coordination.43. Article 246A
Article 246A provides special legislative powers concerning GST to Parliament and State Legislatures, subject to the constitutional provisions concerning inter-State supplies. It represents an important innovation in India's federal tax structure.44. GST Council
Article 279A provides for the GST Council. It is a constitutional institution bringing together representatives of the Union and States for recommendations on important GST-related matters.45. Composition of GST Council
The GST Council includes the Union Finance Minister as Chairperson, the Union Minister of State in charge of Revenue or Finance, and the Minister in charge of Finance or Taxation or another nominated Minister from each State.46. GST Council and Cooperative Federalism
The GST Council institutionalises negotiation between the Union and States in an area where both possess important fiscal interests. Its functioning demonstrates that modern federalism often depends on consultation and bargaining rather than rigid separation.47. GST Council Recommendations
The Supreme Court has emphasised the constitutional character of cooperative federalism while interpreting the status of GST Council recommendations. They carry significant persuasive value within the constitutional framework, but the federal design cannot simply be reduced to an assumption that every recommendation operates as an independently binding command on legislatures. This distinction is important for UPSC conceptual questions.48. Borrowing Powers
Articles 292 and 293 deal with borrowing by the Union and States respectively. State borrowing can involve constitutional conditions, particularly where indebtedness to the Government of India is involved.49. Centrally Sponsored Schemes
Centrally Sponsored Schemes are important instruments of developmental governance involving Union support and State-level implementation or participation. They can promote national priorities but may also generate debate concerning State flexibility, funding patterns and local needs.50. Fiscal Autonomy
Fiscal autonomy means that States possess meaningful financial capacity to discharge constitutionally assigned responsibilities and pursue region-specific priorities. Autonomy does not imply fiscal isolation; transfers and common national programmes remain integral to a federation.51. Inter-State Water Disputes
River-water disputes can become major federal challenges because river basins frequently cross State boundaries. Competing demands arise from irrigation, drinking water, industry, ecology and hydropower.52. Article 262
Article 262 enables Parliament to provide by law for adjudication of disputes relating to waters of inter-State rivers or river valleys. It also permits Parliament to provide for exclusion of the jurisdiction of the Supreme Court and other courts in respect of such disputes.53. Water Disputes as Governance Problems
Water disputes should not be seen only as legal disputes. They involve hydrology, climate variability, agricultural patterns, urban demand, ecological flows and political economy. Long-term solutions therefore require basin-level planning and reliable data in addition to adjudication.54. Inter-State River Water Disputes Tribunals
Parliament has created a statutory framework for adjudicating inter-State river-water disputes through tribunals. Tribunal-based adjudication seeks specialised resolution, but delays in adjudication and implementation have often been concerns in federal governance debates.55. River Basin Approach
A river basin is an ecological unit that often does not correspond with political boundaries. Integrated river-basin management can therefore improve federal cooperation by considering the entire hydrological system rather than isolated territorial claims.56. Inter-State Boundary Disputes
Some States have disputes concerning territorial boundaries. These can involve historical claims, administrative boundaries, linguistic identities and local political interests. Such disputes require constitutionalism, negotiation and political restraint.57. Inter-State Migration
Migration creates another dimension of federalism. Migrant workers may live and work outside their home States while depending on public services in destination States. This creates challenges concerning portability of welfare, housing, healthcare and social protection.58. Portability of Welfare
Portable welfare systems help citizens access eligible benefits across State boundaries. Such arrangements illustrate how technology and intergovernmental coordination can strengthen social federalism.59. Internal Trade and Federalism
Economic integration requires movement of goods, services, labour and capital across State boundaries while respecting constitutional authority. A common economic space can strengthen national development, but regional economic disparities require attention.60. Emergency Provisions and Federalism
Emergency provisions can significantly alter the normal federal balance by strengthening Union authority under specified constitutional circumstances. This is one reason Indian federalism is often described as having a strong centralising capacity during emergencies.61. Article 356
Article 356 concerns failure of constitutional machinery in a State and enables the President to issue a Proclamation according to constitutional conditions. Its use has historically been one of the most debated areas of Centre-State relations.62. S.R. Bommai Case
S.R. Bommai v. Union of India is a landmark decision concerning Article 356 and Indian federalism. The Supreme Court affirmed that Presidential action under Article 356 is subject to judicial review and emphasised constitutional limitations on arbitrary use of the provision.63. Floor Test Principle
Where the question concerns whether a government enjoys majority support in the Legislative Assembly, the floor of the House is generally the appropriate constitutional forum for determining majority. This principle protects democratic legitimacy and reduces reliance on subjective assessments outside the legislature.64. Governor and Federalism
The office of Governor occupies a sensitive position in Centre-State relations. The Governor is a constitutional head of the State but also performs certain constitutional functions that can have significant federal implications.65. Appointment of Governor
Under Article 155, the Governor of a State is appointed by the President by warrant under his hand and seal. The appointment mechanism distinguishes the Indian model from federations where provincial heads may be separately elected.66. Governor's Discretion
The Governor generally functions on the aid and advice of the Council of Ministers except in areas where the Constitution permits discretionary functions. Controversies often arise concerning government formation, reservation of Bills and constitutional crises.67. State Bills and Governor
The constitutional process relating to State legislation includes roles for the Governor and, in certain cases, the President. Delays or disputes concerning State Bills can become significant federal issues because they affect the functioning of elected State Legislatures.68. Federalism and the Judiciary
An independent judiciary is essential to a federation because disputes may arise regarding constitutional competence of the Union and States. The judiciary interprets constitutional boundaries and protects the supremacy of the Constitution.69. Article 131
Article 131 grants the Supreme Court original jurisdiction over specified disputes involving the Government of India and States or between States where the dispute involves a question on which the existence or extent of a legal right depends. This is a major federal provision.70. Federalism as Part of Basic Structure
The Supreme Court's basic-structure jurisprudence recognises federalism as one of the important structural principles of the Constitution. Therefore, constitutional amendment power cannot be used to destroy the fundamental federal character of the constitutional order.71. Asymmetric Federalism
Asymmetric federalism means that all constituent units need not have identical constitutional arrangements. Special constitutional provisions may recognise distinctive historical, tribal, geographical or institutional circumstances of particular regions.72. Fifth Schedule
The Fifth Schedule provides a constitutional framework concerning administration and control of Scheduled Areas and Scheduled Tribes in specified areas. It reflects territorially differentiated governance within the Indian constitutional system.73. Sixth Schedule
The Sixth Schedule provides autonomous institutional arrangements for certain tribal areas in Assam, Meghalaya, Tripura and Mizoram. Autonomous District Councils and related institutions reflect accommodation of regional and tribal diversity.74. Union Territories and Asymmetry
Union Territories do not all follow an identical administrative model. Some possess legislatures and distinctive constitutional or statutory arrangements, while others are administered through different institutional structures. This is another manifestation of constitutional asymmetry.75. Federalism and Local Government
The 73rd and 74th Constitutional Amendments strengthened the constitutional position of Panchayats and Municipalities. Although India remains constitutionally structured around the Union-State relationship, effective decentralisation increasingly requires meaningful empowerment of local governments.76. Principle of Subsidiarity
Subsidiarity suggests that public functions should, where feasible, be performed by the lowest level of government capable of effectively carrying them out. It can improve responsiveness, accountability and citizen participation.77. The 3Fs
Effective decentralisation requires adequate transfer of: 1. Functions. 2. Funds. 3. Functionaries. Assigning responsibilities without financial resources or administrative personnel produces weak decentralisation.78. State Finance Commissions
State Finance Commissions are constitutionally envisaged to review the financial position of Panchayats and Municipalities and make recommendations according to the constitutional framework. Their effective functioning is important for fiscal decentralisation below the State level.79. Federalism and Public Health
Public health demonstrates the need for cooperative federalism. State governments play major roles in health administration, while national institutions may contribute financing, standards, disease surveillance and coordination. Epidemics show that administrative borders cannot fully contain many public-health risks.80. Federalism and Disaster Management
Floods, cyclones, earthquakes, heatwaves and other disasters often require coordinated action by local, State and Union institutions. A rigidly compartmentalised model is inadequate for complex emergencies.81. Federalism and Climate Change
Climate policy increasingly has federal dimensions. National commitments must often be implemented through State-level action in energy, transport, agriculture, forests, urban planning and disaster resilience. States therefore function as major laboratories of climate adaptation and policy innovation.82. Environmental Federalism
Environmental problems frequently cross administrative boundaries. Air pollution, river pollution, forests, biodiversity and waste flows require coordination among jurisdictions. Environmental federalism must balance national standards with local ecological circumstances.83. Federalism and Agriculture
Agriculture has strong State-level constitutional and administrative dimensions, while agricultural markets, trade, food security, credit and national economic policies can involve multiple levels of government. Agricultural reform therefore often requires consultation rather than unilateral policy design.84. Federalism and Education
Education is in the Concurrent List. Both the Union and States therefore possess important legislative and policy roles within the constitutional framework. This enables national coordination while allowing adaptation to linguistic, cultural and regional requirements.85. Federalism and Police
Police and public order are State List subjects, while national security and inter-State criminal challenges can require coordination with Union institutions. Cybercrime, terrorism and organised crime illustrate the growing importance of cooperative security federalism.86. Federalism and Digital Governance
Digital public systems increasingly connect Union, State and local databases and services. Interoperability can improve service delivery, but questions concerning privacy, cybersecurity, data quality and institutional responsibility must be addressed.87. Data Federalism
Good intergovernmental policy requires reliable and comparable data. However, excessive centralisation of data can reduce State ownership, while incompatible State systems can undermine national coordination. Shared standards combined with appropriate institutional autonomy can provide a better balance.88. Policy Innovation by States
Federalism allows States to function as policy laboratories. Innovations in healthcare, education, welfare, agriculture, digital governance and local administration can be tested at State level and subsequently adapted elsewhere. This is a major developmental advantage of federalism.89. One-Size-Fits-All Problem
India's States differ substantially in geography, demographics, administrative capacity and development levels. Uniform policy design may therefore produce unequal outcomes. National standards may be necessary in some areas, but implementation flexibility can improve effectiveness.90. Regional Political Parties
Regional parties have played an important role in the evolution of Indian federalism by articulating State-specific and regional interests at the national level. Coalition politics historically strengthened bargaining between national and regional political actors in several periods.91. Political Federalism
Federalism is shaped not only by constitutional text but also by the party system, electoral competition and political relationships between governments. The same constitutional provisions may operate differently depending on whether the same or different political parties govern at the Union and State levels.92. Trust Deficit
A major challenge to cooperative federalism is lack of trust between governments. If consultation is perceived as symbolic or if legitimate State concerns are ignored, constitutional disputes can become political conflicts.93. Consultation Before Major Reforms
Where reforms significantly affect State responsibilities or finances, meaningful consultation can improve both legitimacy and implementation. Consultation does not require unanimity, but it strengthens federal trust.94. Institutionalised Consultation
Regular institutions of intergovernmental dialogue are preferable to crisis-driven negotiation. The Inter-State Council, GST Council, Zonal Councils and sector-specific forums can contribute to institutionalised federal dialogue.95. Federalism and National Unity
Federalism should not be treated as opposed to national unity. By accommodating regional diversity and giving citizens multiple channels of political participation, federalism can strengthen national integration. Suppression of legitimate regional aspirations may sometimes weaken rather than strengthen unity.96. Federalism and Regional Inequality
Large developmental differences among States can create political and fiscal tensions. Equal treatment does not necessarily require identical transfers. Fiscal equalisation may require consideration of different capacities and needs.97. Equity versus Efficiency
Fiscal transfers must balance several objectives: equity, efficiency, fiscal responsibility and incentives for improved performance. Excessive dependence can weaken incentives, while inadequate transfers can deepen regional inequality.98. Moral Hazard in Fiscal Federalism
If governments expect unconditional rescue regardless of fiscal behaviour, incentives for responsible budgeting may weaken. A sound federal fiscal system therefore needs both solidarity and fiscal accountability.99. Conditional and Unconditional Transfers
Conditional transfers can support national objectives, while unconditional transfers give States greater flexibility to respond to local priorities. A balanced fiscal architecture may require both.100. State Capacity
Greater autonomy produces better outcomes only when governments possess adequate administrative, financial and technical capacity. Federal reform must therefore be accompanied by institution-building.101. Major Challenges to Indian Federalism
Important challenges include: 1. Fiscal imbalances. 2. Inter-State disputes. 3. Politicisation of constitutional offices. 4. Inadequate consultation. 5. Regional developmental inequality. 6. Weak local decentralisation. 7. Overlapping responsibilities. 8. Disputes over centrally designed programmes. 9. Unequal administrative capacity. 10. Trust deficits between governments.102. Sarkaria Commission
The Sarkaria Commission examined Centre-State relations and recommended strengthening cooperative functioning within the existing constitutional framework. It remains important for UPSC because many contemporary federal debates relate to themes addressed by the Commission.103. Punchhi Commission
The Punchhi Commission subsequently examined changing dimensions of Centre-State relations, including Governors, emergencies and other federal issues. Students should understand these commissions as major sources of federal reform proposals rather than merely memorising their names.104. Strengthening the Inter-State Council
More regular meetings, systematic agenda-setting and follow-up mechanisms could improve the effectiveness of the Inter-State Council as a forum for federal dialogue. Institutional dialogue can prevent political disagreements from immediately becoming constitutional confrontations.105. Reforming Fiscal Federalism
A stronger fiscal federation requires predictable transfers, transparent criteria, adequate State fiscal space and incentives for responsible financial management. States should have sufficient resources to discharge their constitutional responsibilities.106. Strengthening State Finance Commissions
Fiscal federalism cannot stop at State capitals. Panchayats and Municipalities require predictable and adequate resources. Regular constitution and implementation of State Finance Commission recommendations can strengthen grassroots governance.107. Resolving Water Disputes
Reforms should emphasise reliable hydrological data, time-bound dispute resolution, basin-level institutions, ecological sustainability and cooperative implementation. Adjudication without implementation mechanisms may not provide lasting solutions.108. Reforming the Governor's Office
The credibility of the Governor's office depends on constitutional impartiality, restraint, timely decision-making and respect for democratic processes. Constitutional offices should not become instruments of routine partisan competition.109. Fiscal Transparency
Both the Union and States should maintain transparent accounts, credible fiscal reporting and responsible borrowing practices. Federal autonomy and fiscal responsibility should reinforce rather than undermine one another.110. Strengthening State Capacity
Administrative reforms, professional civil services, digital infrastructure, local capacity and evidence-based policymaking can enable States to exercise autonomy more effectively. Federalism works best when every level of government is institutionally capable.111. Prelims Trap — Federalism Means Complete Separation
Incorrect. Modern federations involve extensive overlap and cooperation. India's Constitution itself provides several mechanisms for shared or coordinated governance.112. Prelims Trap — State List Is Absolutely Exclusive
Incorrect. Although State Legislatures ordinarily legislate on State List matters, Articles 249, 250, 252 and 253 illustrate circumstances in which Parliament can legislate in areas otherwise associated with the State List.113. Prelims Trap — State Consent Is Mandatory under Article 3
