A British citizen residing in India cannot claim the freedom of trade, occupation or profession guaranteed under Article 19 because the freedoms contained in Article 19 are specifically guaranteed to citizens of India.
Article 19 includes freedom of speech and expression, peaceful assembly, association, movement, residence and the freedom to practise a profession or carry on an occupation, trade or business.
Foreign nationals do not acquire these Article 19 rights merely because they are legally residing in India.
This does not mean that foreigners are without constitutional protection.
Article 14 uses the expression 'any person' and therefore protects equality before law for citizens as well as foreigners, subject to constitutionally recognised exceptions.
Article 21 similarly protects the life and personal liberty of every person.
Religious freedoms under Articles 25 to 28 are also generally framed in terms of persons rather than citizenship alone.
The examination principle is therefore simple: Article 19 freedoms are citizen-specific, whereas several other Fundamental Rights are available to both citizens and non-citizens.
भारत में रहने वाला ब्रिटिश नागरिक अनुच्छेद 19 के अंतर्गत व्यापार, व्यवसाय या पेशा करने की स्वतंत्रता का दावा नहीं कर सकता, क्योंकि अनुच्छेद 19 में दी गई स्वतंत्रताएं विशेष रूप से भारतीय नागरिकों के लिए हैं। अनुच्छेद 19 में वाक् एवं अभिव्यक्ति की स्वतंत्रता, शांतिपूर्ण सभा, संघ बनाने, संचरण, निवास तथा कोई वृत्ति, व्यापार या व्यवसाय करने की स्वतंत्रता शामिल है। केवल भारत में वैध रूप से निवास करने से किसी विदेशी व्यक्ति को अनुच्छेद 19 के ये अधिकार प्राप्त नहीं हो जाते। इसका अर्थ यह नहीं है कि विदेशी व्यक्तियों को कोई संवैधानिक संरक्षण प्राप्त नहीं होता। अनुच्छेद 14 में 'किसी व्यक्ति' की अवधारणा के कारण विधि के समक्ष समानता नागरिक और विदेशी दोनों को प्राप्त होती है। अनुच्छेद 21 भी प्रत्येक व्यक्ति के जीवन और व्यक्तिगत स्वतंत्रता की रक्षा करता है। इसी प्रकार अनुच्छेद 25 से 28 तक धार्मिक स्वतंत्रता के अधिकार भी व्यापक रूप से व्यक्तियों को उपलब्ध हैं। परीक्षा के लिए मुख्य अंतर यह है कि अनुच्छेद 19 की स्वतंत्रताएं केवल नागरिकों को प्राप्त हैं।
