Article 49 concerns the protection of monuments, places and objects of artistic or historic interest that have been declared by or under law made by Parliament to be of national importance.
The State is required to protect such heritage from spoliation, disfigurement, destruction, removal, disposal or export, as the case may be.
Cultural heritage is significant because monuments and historic objects preserve evidence of a country's history, architecture, art and social development.
Once destroyed or irreversibly damaged, many such resources cannot be recreated.
Constitutional protection therefore recognises preservation of heritage as a public responsibility rather than merely a matter of private ownership.
