Habeas Corpus literally conveys the idea of producing or bringing the detained person before the court.
The writ protects individuals against unlawful detention.
When a petition for Habeas Corpus is entertained, the court examines whether the authority or person detaining someone has lawful justification for doing so.
The focus is therefore not on determining guilt for an offence but on determining the legality of the detention itself.
If no valid legal basis exists, the court may order immediate release.
Habeas Corpus occupies a special place in constitutional law because personal liberty would have little practical value if a person could be detained unlawfully without access to judicial review.
It is closely associated with Article 21, which protects life and personal liberty.
Students should distinguish its meaning from other writs: Mandamus broadly means 'we command', Prohibition means preventing an inferior judicial body from exceeding jurisdiction, and Quo Warranto concerns the authority by which a person holds a public office.
Habeas Corpus is therefore fundamentally a liberty-protecting remedy.
