Explanationव्याख्या

Habeas Corpus can be issued in relation to unlawful detention caused by either a public authority or a private individual.
Its central concern is the liberty of the detained person rather than merely the official status of the detaining party.
If a government authority detains a person without lawful justification, the writ can be used to test that detention.
Similarly, if a private person unlawfully confines another individual, judicial intervention through Habeas Corpus may also be possible.
The court requires production of the detained person or an explanation of the legal basis for detention and examines whether continued confinement is lawful.
This distinguishes Habeas Corpus from Mandamus, which is ordinarily concerned with compelling performance of a public duty.
Habeas Corpus is closely connected with Article 21 because arbitrary or unlawful detention directly affects personal liberty.
Its broad protective character explains why it is traditionally regarded as one of the strongest judicial safeguards against unlawful confinement.

बंदी प्रत्यक्षीकरण रिट अवैध निरोध की स्थिति में सार्वजनिक प्राधिकारी और निजी व्यक्ति दोनों के विरुद्ध जारी की जा सकती है। इसका मुख्य उद्देश्य यह देखना है कि निरुद्ध व्यक्ति की स्वतंत्रता वैध रूप से छीनी गई है या नहीं; इसलिए केवल बंदी बनाने वाले व्यक्ति की सरकारी या निजी स्थिति निर्णायक नहीं होती। यदि कोई सरकारी अधिकारी बिना वैध कानूनी आधार के किसी व्यक्ति को निरुद्ध करता है, तो इस रिट के माध्यम से निरोध की वैधता की जांच की जा सकती है। इसी प्रकार किसी निजी व्यक्ति द्वारा किसी अन्य व्यक्ति को अवैध रूप से बंदी बनाए जाने पर भी न्यायिक हस्तक्षेप संभव हो सकता है। न्यायालय निरुद्ध व्यक्ति को प्रस्तुत करने या निरोध का कानूनी आधार बताने का आदेश देकर उसकी वैधता की जांच करता है। इसे परमादेश से अलग समझें, जिसका प्रमुख उद्देश्य सार्वजनिक कर्तव्य का पालन कराना है। बंदी प्रत्यक्षीकरण का अनुच्छेद 21 में संरक्षित व्यक्तिगत स्वतंत्रता से अत्यंत निकट संबंध है।
