What Happened

1. Why in News?
In an order dated 15 October 2026, the Supreme Court of India recognised access to and use of the internet as a fundamental right of every individual, including children. The decision attracted widespread attention because it addressed the relationship between constitutional freedoms, children's online safety and the responsibilities of digital platforms.

2. Court and Case
The order was passed in Just Rights for Children Alliance and Another versus S. Harish and Others. It arose in proceedings connected with earlier directions concerning the identification and removal of child sexual exploitation and abuse material from online services.

3. Bench of the Supreme Court
The bench comprised Justice J. B. Pardiwala and Justice K. Vinod Chandran. Their observations emphasised that children's constitutional freedoms must be considered alongside measures intended to protect them from harmful online content.

4. Constitutional Foundation
The Court located the right to access and use the internet within Article 21 read with Article 19(1)(a) of the Constitution. These provisions concern the right to life and personal liberty and the freedom of speech and expression respectively.

5. Article 21
Article 21 protects life and personal liberty according to the procedure established by law. Judicial interpretation has developed its scope to include important aspects of human dignity, autonomy, education-related access and meaningful participation in modern life.

6. Article 19(1)(a)
Article 19(1)(a) guarantees citizens the freedom of speech and expression. In a digital society, the internet is an important medium for expressing opinions, receiving information, learning and communicating with others.

7. Rights of Children
The Court recognised that children also enjoy constitutional rights. Their age does not justify treating them as persons without freedom of expression or a legitimate interest in accessing information and educational resources.

8. Why the Internet Matters
The internet supports education, communication, access to public information, digital services and social participation. For some people, particularly those living in remote locations, online access may be an important way to obtain learning resources and communicate with others.

9. The Question of Online Safety
The proceedings concerned serious risks associated with harmful and exploitative online material involving children. The Court considered how digital platforms and public authorities should address these risks without imposing unjustified restrictions on children themselves.

10. Rejection of Blanket Restrictions
The Court cautioned against blanket prohibitions on children's internet access. It reasoned that protecting children from online harm should not automatically require denying them access to a medium that is increasingly important for education and communication.

11. Rights Are Not Unlimited
Recognition of internet access as a fundamental right does not mean every online activity or category of content must remain unrestricted. Reasonable and proportionate safeguards may still be necessary, particularly where content is unlawful or inherently harmful.

12. Principle of Proportionality
Proportionality requires that restrictions on rights be justified in relation to a legitimate objective and should not go further than necessary. In the context of online child safety, it supports targeted protective measures rather than indiscriminate denial of access.

13. Child Mode for Social Media
The Court discussed the possibility of a dedicated child mode for social media accounts. Such a mode could provide age-appropriate settings, additional privacy protection and safer interactions while preserving access to useful digital services.

14. Default Privacy Settings
One potential safeguard is to make children's accounts private by default. This can reduce exposure to unknown users and help limit unwanted contact, although technical design and actual effectiveness would require careful implementation.

15. Restrictions on Unknown Contacts
Age-appropriate safety features may restrict unsolicited messages or contact from unknown adults. These measures aim to reduce risks without preventing children from using the internet for legitimate purposes.

16. Content Moderation
Digital platforms may need stronger systems for identifying and removing prohibited content. Effective moderation requires appropriate technical tools, trained personnel, reporting mechanisms and accountability.

17. Parental Guidance
The Court discussed the importance of parental consent, guidance and supervision in children's online activities. Protective arrangements should take account of age and maturity while respecting privacy and other legal safeguards.

18. Digital Literacy
Teaching children to recognise suspicious messages, protect personal information and report harmful content can complement technological protections. Digital literacy is an important part of online safety rather than a substitute for platform responsibilities.

19. Child Sexual Exploitation and Abuse Material
Child sexual exploitation and abuse material is often abbreviated as CSEAM. Its creation, distribution and circulation involve serious violations of children's rights and may attract criminal liability under applicable Indian laws.

20. Importance of Detection and Removal
The Court addressed the need to improve the identification and removal of CSEAM from online services. The objective is to reduce the circulation of unlawful material and strengthen coordinated responses by relevant authorities and digital intermediaries.

21. National Database Proposal
The order called for stronger national-level mechanisms, including a database approach involving digital identifiers and web addresses associated with identified unlawful material. Such systems can help support coordinated detection and removal efforts.

22. Hash Matching
Hash matching uses digital identifiers derived from files to help detect known content. Perceptual hashing can assist in recognising visually similar material even when a file has undergone certain changes. These technologies require careful governance and safeguards against misuse.

23. URL-Based Detection
A URL identifies the online location of a resource. Maintaining information about verified locations hosting unlawful material can assist removal and blocking processes, subject to legal procedures and appropriate safeguards.

24. Responsibilities of Intermediaries
Social media platforms and other intermediaries play an important role in responding to reports of unlawful content. Their obligations are governed by applicable laws, rules and judicial directions.

25. Information Technology Act
The Information Technology Act, 2000 provides an important legal framework for electronic communications and certain online offences. It also contains provisions concerning the responsibilities and conditional liability protections of intermediaries.

26. Section 79 of the IT Act
Section 79 provides conditional protection from liability for intermediaries in specified circumstances. This protection is not unconditional and depends on compliance with applicable statutory requirements.

27. Section 67B of the IT Act
Section 67B concerns specified offences involving sexually explicit material depicting children in electronic form. It is relevant to the legal framework for combating online exploitation of minors.

28. POCSO Act
The Protection of Children from Sexual Offences Act, 2012 provides a specialised legal framework addressing sexual offences against children. It is important for understanding the wider legal context of the Court's directions.

29. Earlier Supreme Court Proceedings
The October 2026 order followed earlier Supreme Court proceedings in the same litigation, including directions issued in September 2024. It therefore forms part of a continuing judicial effort to improve responses to online child exploitation.

30. Anuradha Bhasin Case
In Anuradha Bhasin versus Union of India, decided in 2020, the Supreme Court addressed restrictions on internet services and the exercise of constitutional freedoms through the internet. The case is important for questions concerning internet shutdowns, legality and proportionality.

31. Pragya Prasun Case
In Pragya Prasun versus Union of India in 2025, the Supreme Court addressed digital access in relation to constitutional protections. The 2026 order builds upon the broader development of jurisprudence concerning meaningful digital participation.

32. Internet Access and Education
Online learning platforms, educational videos, digital libraries and communication tools can help students access educational resources. Excluding children from the internet altogether could also exclude them from useful learning opportunities.

33. Rural and Remote Areas
Children in remote areas may rely heavily on digital services where physical educational resources are limited. Improving safe access can therefore contribute to reducing geographical disparities in educational opportunities.

34. Children with Disabilities
Accessible digital technologies can help children with disabilities obtain information, communicate and participate in learning. Effective online safety measures should also consider accessibility needs.

35. Privacy Concerns
Age verification and parental control systems can create privacy risks if they collect excessive personal information. Appropriate safeguards are necessary to prevent unnecessary surveillance or misuse of children's data.

36. Role of Government
Government authorities are responsible for developing and enforcing legal frameworks that protect children and respect constitutional rights. The Court's directions call for attention to effective implementation rather than reliance only on broad prohibitions.

37. Role of Technology Companies
Digital companies can contribute through safer default settings, responsive reporting channels, transparent content policies and reliable methods for detecting unlawful material. These measures should be designed with attention to user rights and technical limitations.

38. What the Order Does Not Mean
The order does not establish an unlimited entitlement to access every website or service. It also does not mean that all age-based safeguards are unconstitutional. The central distinction is between proportionate protections and unjustified blanket denial of internet access.

39. Next Stage of Proceedings
The litigation involves continuing judicial supervision of implementation measures. Reports about the order identify 10 December 2026 as the next scheduled hearing. Students should distinguish the date of the October order from future compliance proceedings.

40. Overall Significance
The Supreme Court's October 2026 order is an important development in Indian constitutional law and digital governance. It recognises that internet access is connected with fundamental freedoms while insisting that children's online safety must be addressed through effective and proportionate safeguards. The case is especially relevant to questions on Articles 19 and 21, digital rights, child protection and the regulation of online platforms.

Background

The growth of digital communication has made internet access increasingly important for education, information, expression and participation in public life. At the same time, the circulation of unlawful and exploitative online material creates serious challenges, especially for children. In September 2024, the Supreme Court issued directions in litigation concerning child sexual exploitation and abuse material. Subsequent proceedings examined the effectiveness of detection and removal systems and the responsibilities of online intermediaries. On 15 October 2026, a bench of Justices J. B. Pardiwala and K. Vinod Chandran considered these questions in Just Rights for Children Alliance and Another versus S. Harish and Others. The Court recognised access to and use of the internet as a fundamental right under Article 21 read with Article 19(1)(a), including for children. It cautioned against blanket prohibitions and discussed proportionate protective measures, including age-appropriate platform settings, parental guidance and stronger mechanisms to identify and remove unlawful material. The order forms part of India's evolving jurisprudence on digital rights and online child protection.

Why It Matters

The order is significant because it brings children's digital access within the discussion of constitutional rights while recognising the serious risks of online exploitation. It encourages policymakers to distinguish between restricting unlawful or harmful content and excluding children from the internet altogether. The decision is relevant to education, digital inclusion, privacy, platform accountability and the regulation of online services. It also illustrates the constitutional principle that restrictions on rights should be justified and proportionate. For competitive examinations, the case connects Articles 19 and 21 with contemporary issues in governance, child protection, information technology and the responsibilities of intermediaries.
