Federalism in India: Complete UPSC GS Paper 2 Notes

Federalism is a constitutional arrangement in which governing authority is distributed between two or more levels of government. In India, the Union and the states derive their powers from the Constitution. The Indian model combines federal principles with significant centralizing features, reflecting the country's historical circumstances, geographical diversity, developmental challenges and commitment to national unity.

Federalism is not merely an administrative technique. It is also a democratic principle that accommodates linguistic, cultural, regional and political diversity while maintaining constitutional unity. Understanding Indian federalism requires examining constitutional provisions, political practice, judicial interpretation, fiscal arrangements and intergovernmental institutions.

1. Constitutional Foundation of Indian Federalism

Article 1 describes India as a Union of States. The Constitution establishes two principal constitutional levels of government: the Union and the states. Local self-government institutions also have constitutional recognition under Parts IX and IXA.

The Constitution distributes legislative powers, establishes separate executive authorities and provides mechanisms for resolving disputes. The Supreme Court protects constitutional boundaries through judicial review.

Unlike a confederation, India's states do not possess a constitutional right to secede. Parliament also possesses significant authority regarding the formation and reorganization of states under Articles 3 and 4, subject to constitutional procedures.

2. Federal Features of the Indian Constitution

Important federal features include a written Constitution, constitutional supremacy, distribution of legislative powers, an independent judiciary, a bicameral Parliament with the Rajya Sabha representing states, and a constitutional amendment procedure requiring state ratification for specified matters.

The existence of separate Union and state governments allows governance responsibilities to be exercised at different territorial levels. The Seventh Schedule provides the principal framework for distributing legislative subjects.

3. Centralizing Features of Indian Federalism

India's Constitution also contains significant centralizing provisions. These include a strong Union List, residuary legislative powers vested in Parliament, emergency provisions, integrated judicial arrangements, All India Services, a single citizenship and Parliament's power to reorganize state boundaries.

These provisions were designed partly to address the challenges of national integration and coordinated governance. However, excessive centralization can generate tensions when states perceive encroachment on their constitutionally assigned responsibilities.

4. Is India Federal or Unitary?

India cannot be adequately described as either a conventional federation or a purely unitary state. The Constitution establishes a federal distribution of authority while allowing the Union to exercise exceptional or overriding powers in specified circumstances.

The Supreme Court has recognized federalism as part of the Constitution's basic structure. Therefore, even though Parliament has extensive constitutional powers, the essential federal character of the constitutional system cannot be destroyed through an ordinary constitutional amendment.

5. Seventh Schedule: Distribution of Legislative Powers

Article 246, read with the Seventh Schedule, distributes legislative subjects among three lists: the Union List, State List and Concurrent List.

The Union List includes matters of national importance such as defence, foreign affairs, currency and banking. The State List includes subjects such as public order, police, public health and agriculture, subject to constitutional qualifications. The Concurrent List includes subjects such as education, forests, marriage and criminal law.

The lists must be interpreted together with relevant constitutional provisions and judicial principles. Their operation is more nuanced than a simple rigid division of policy areas.

6. Residuary Powers

Article 248, read with Entry 97 of the Union List, gives Parliament the power to legislate on matters not enumerated in the State List or Concurrent List, including certain taxation matters.

This differs from some federations where residuary powers belong to constituent states. India's allocation reflects its comparatively strong Union framework.

7. Parliamentary Legislation on State List Subjects

Parliament may legislate on State List matters under specified constitutional conditions. Under Article 249, the Rajya Sabha may authorize such legislation by a resolution supported by at least two-thirds of members present and voting when it is necessary or expedient in the national interest.

Under Article 250, Parliament can legislate on State List matters while a Proclamation of Emergency is in operation. Article 252 allows Parliament to legislate for two or more consenting states on specified State List matters, with other states able to adopt the legislation subsequently.

Article 253 empowers Parliament to make laws for implementing international treaties, agreements and conventions, notwithstanding the ordinary distribution of legislative subjects.

8. Repugnancy and Article 254

When a state law and a parliamentary law conflict on a Concurrent List matter, Article 254 generally gives precedence to the parliamentary law to the extent of repugnancy.

Under Article 254(2), a state law concerning a Concurrent List matter that has been reserved for the President's consideration and receives presidential assent may prevail within that state despite inconsistency with an earlier parliamentary law. Parliament nevertheless retains the power to override it through subsequent legislation.

Repugnancy analysis requires examining the subject matter, actual inconsistency and constitutional conditions rather than assuming that every difference between Union and state laws automatically invalidates the state law.

9. Administrative Relations

Articles 256 and 257 address important aspects of administrative relations. Article 256 requires state executive power to be exercised so as to ensure compliance with laws made by Parliament and existing laws applicable in the state. Article 257 provides that state executive power must not impede or prejudice the exercise of Union executive power and permits certain Union directions.

The Union and states may also entrust functions to one another under constitutional arrangements, including Articles 258 and 258A.

Administrative cooperation is necessary because many national programmes depend on implementation through state-level institutions.

10. All India Services

All India Services, including the Indian Administrative Service and Indian Police Service, form an important institutional link between the Union and states. Officers serve under both levels of government at different stages of their careers.

Article 312 provides the constitutional mechanism for the creation of new All India Services when the Rajya Sabha passes a resolution by the prescribed special majority.

These services can promote administrative continuity and national standards. However, disputes concerning cadre management, deputation and administrative control can become sources of Centre-State friction.

11. The Governor and Federal Relations

The Governor is the constitutional head of a state and is appointed by the President under Article 155. The office performs constitutional functions within the parliamentary system of state government.

Controversies sometimes arise concerning government formation, summoning legislative sessions, assent to bills and reports under Article 356. Such controversies raise questions about constitutional morality, impartiality and the proper boundaries of discretionary authority.

The Governor is not a parallel elected executive. The office must function within the constitutional scheme, including the principles governing aid and advice and limited discretionary powers.

12. Assent to State Bills and Article 200

Article 200 governs the Governor's options when a bill passed by the state legislature is presented for assent. These include granting assent, withholding assent, reserving the bill for presidential consideration and, for eligible bills, returning it for reconsideration.

The constitutional framework must be read with the relevant provisos and judicial interpretation. The Governor cannot treat the assent process as an unrestricted political veto.

For UPSC preparation, the distinction between constitutional text, judicial interpretation and later legal developments is especially important. Specific timelines or remedies should not be stated as universally binding without checking the latest authoritative judicial position.

13. President's Rule and Article 356

Article 356 permits a Proclamation when the President, on receiving a report from the Governor or otherwise, is satisfied that the government of a state cannot be carried on in accordance with the Constitution.

This is an exceptional constitutional mechanism rather than an ordinary instrument for resolving political disagreements. Its use is subject to constitutional procedures, parliamentary approval and judicial review.

In S. R. Bommai v. Union of India (1994), the Supreme Court imposed important constitutional limitations on the misuse of Article 356 and emphasized the relevance of floor tests and judicial review.

14. Inter-State Council

Article 263 provides for the establishment of an Inter-State Council when the President considers that public interests would be served by such a body.

The Council may be assigned functions concerning the investigation and discussion of disputes, discussion of subjects of common interest and recommendations for better coordination of policy and action.

The Inter-State Council was established in 1990. Its potential lies in facilitating structured dialogue between the Union and states, although effectiveness depends on regular meetings, substantive consultation and follow-up.

15. Zonal Councils

Zonal Councils are statutory bodies established under the States Reorganisation Act, 1956. They provide forums for discussing common regional problems and promoting cooperation among states and the Union.

They are distinct from the constitutional Inter-State Council under Article 263. The North Eastern Council has a separate statutory basis under the North Eastern Council Act, 1971.

Regional forums can help address border concerns, infrastructure coordination, transport, security and development issues through dialogue.

16. Inter-State Water Disputes

River systems often cross state boundaries, creating disputes over water allocation, irrigation, drinking water, hydropower and environmental requirements.

Article 262 empowers Parliament to provide for adjudication of disputes relating to the use, distribution or control of waters of inter-state rivers or river valleys. Parliament may also exclude the jurisdiction of the Supreme Court and other courts over specified disputes under a law made pursuant to Article 262.

The Inter-State River Water Disputes Act, 1956 establishes a statutory mechanism for adjudication. Disputes involving river systems such as Cauvery, Krishna and Ravi-Beas demonstrate the importance of legal processes, data sharing and cooperative basin management.

17. Fiscal Federalism: Meaning

Fiscal federalism concerns the distribution of taxation powers, expenditure responsibilities, transfers and borrowing arrangements among different levels of government.

India faces vertical fiscal imbalances because revenue-raising powers and expenditure responsibilities are not distributed identically between the Union and states. Horizontal imbalances also arise because states differ in population, income, geography, fiscal capacity and developmental needs.

Fiscal transfers aim to support equitable public services while maintaining incentives for responsible financial management.

18. Finance Commission and Article 280

Article 280 provides for a Finance Commission constituted by the President at intervals of five years or earlier when necessary.

The Commission recommends, among other matters, the distribution of the net proceeds of taxes between the Union and states, allocation among states of their respective shares and principles governing certain grants-in-aid.

It also recommends measures to augment state consolidated funds to supplement the resources of panchayats and municipalities on the basis of state finance commission recommendations.

Finance Commission recommendations are important inputs into fiscal policy but should not be confused with automatically self-executing constitutional commands in every detail.

19. Tax Devolution and Grants-in-Aid

Tax devolution distributes a constitutionally determined share of divisible Union tax proceeds among states. Grants-in-aid provide another channel for fiscal support, including grants under Article 275.

Not every Union tax receipt forms part of the divisible pool. Constitutionally specified cesses and surcharges are generally excluded from the divisible pool, subject to the applicable constitutional provisions.

Debates over the increasing use of cesses and surcharges concern transparency, fiscal autonomy and the effective resources available for sharing with states.

20. Goods and Services Tax and Cooperative Federalism

The Goods and Services Tax is a major example of institutionalized fiscal coordination between the Union and states. The Constitution (One Hundred and First Amendment) Act, 2016 introduced significant changes to India's indirect taxation framework.

Article 246A provides special legislative powers concerning GST, while Article 269A deals with GST on supplies in the course of inter-state trade or commerce. Article 279A establishes the GST Council.

The GST framework combines common national market objectives with shared fiscal decision-making. Nevertheless, disputes can arise over rates, compensation, administrative arrangements and revenue autonomy.

21. GST Council: Composition and Voting

The GST Council is chaired by the Union Finance Minister. Its membership includes the Union Minister of State in charge of Revenue or Finance and the state ministers responsible for finance or taxation, or other ministers nominated by state governments.

Under Article 279A, decisions at Council meetings are taken by a majority of not less than three-fourths of the weighted votes of members present and voting. The Union government's vote carries one-third of the total weight, while the votes of all state governments taken together carry two-thirds.

This arrangement makes consensus-building politically and institutionally important. The constitutional voting design does not give each individual state an equal one-third or two-thirds share.

22. Are GST Council Recommendations Binding?

In Union of India v. Mohit Minerals Pvt. Ltd. (2022), the Supreme Court discussed the constitutional position of GST Council recommendations and emphasized their persuasive character within India's cooperative federal framework.

The Court held that the Council's recommendations are not automatically binding on Parliament and state legislatures merely by virtue of Article 279A. However, the precise legal effect of recommendations must be assessed in light of the applicable statutory provisions and the particular issue involved.

This judgment is important for understanding the balance between harmonized taxation and constitutional legislative authority.

23. Cooperative Federalism

Cooperative federalism describes a model in which the Union and states coordinate policies, share information, negotiate differences and jointly address public problems.

Examples include intergovernmental councils, the GST Council, centrally supported programmes and joint responses to disasters and public health challenges.

Genuine cooperation requires timely consultation, mutual respect, predictable financial arrangements, institutional transparency and mechanisms for resolving disagreements.

24. Competitive Federalism

Competitive federalism refers to states competing to improve governance, investment conditions, infrastructure, public services and economic performance.

Healthy competition can encourage policy innovation and administrative efficiency. However, competition can become counterproductive when it weakens labour protections, environmental safeguards or equitable access to essential services.

Cooperative and competitive federalism are not mutually exclusive. States may cooperate on shared problems while competing to improve service delivery and development outcomes.

25. NITI Aayog and Federal Cooperation

NITI Aayog was established in 2015 as a policy institution intended to promote strategic planning, policy innovation and cooperative federalism.

Its Governing Council provides a platform for discussions involving the Union and state leadership. NITI Aayog also supports data-driven policy analysis and collaboration across governments.

Unlike the Finance Commission, NITI Aayog is not a constitutional body established under Article 280. Its role and institutional authority are different.

26. Centrally Sponsored Schemes

Centrally Sponsored Schemes involve Union financial support for programmes implemented substantially through state institutions, often with specified cost-sharing arrangements and programme guidelines.

Such schemes can advance national development priorities and support states with limited resources. However, concerns include reduced flexibility, administrative complexity, delayed fund releases and mismatch between national design and local needs.

Improving these schemes requires greater flexibility, transparent outcomes, reliable financing and meaningful state consultation.

27. Local Governments and Federal Decentralization

The 73rd and 74th Constitutional Amendments gave constitutional recognition to rural and urban local self-government institutions.

Parts IX and IXA provide frameworks for panchayats and municipalities. The Eleventh and Twelfth Schedules list matters that may be entrusted to these institutions, subject to state legislation and constitutional arrangements.

Effective decentralization requires adequate functions, finances and functionaries. Constitutional recognition alone does not guarantee meaningful fiscal or administrative autonomy.

28. Asymmetric Federalism

Asymmetric federalism refers to arrangements in which different constituent units possess distinct constitutional or institutional provisions.

India's constitutional framework contains special provisions for certain states and regions, including provisions under Articles 371 and related articles. The Sixth Schedule provides autonomous district and regional council arrangements for specified tribal areas in Assam, Meghalaya, Tripura and Mizoram.

Such arrangements seek to accommodate distinctive historical, cultural, geographical and administrative circumstances within the Union.

29. Federalism and the Basic Structure Doctrine

The basic structure doctrine limits Parliament's power to amend the Constitution under Article 368. The Supreme Court's decision in Kesavananda Bharati v. State of Kerala (1973) established that constitutional amendments cannot destroy the Constitution's basic structure.

Federalism has subsequently been recognized as an essential constitutional feature, including in the reasoning of S. R. Bommai v. Union of India.

The doctrine protects the constitutional identity of the federal system while allowing lawful changes to institutional arrangements.

30. Major Challenges to Indian Federalism

Important challenges include fiscal imbalances, disputes over the Governor's constitutional role, delays in intergovernmental consultation, river-water disputes, overlapping responsibilities, differences over centrally designed programmes and uneven administrative capacities.

Political competition between different parties governing the Union and states may intensify tensions, but constitutional federalism requires institutions to function independently of partisan convenience.

Additional challenges include climate adaptation, migration, public health coordination, urbanization and management of natural resources that cross state boundaries.

31. Reforms for Strengthening Indian Federalism

First, strengthen regular consultation through the Inter-State Council and other intergovernmental forums. Second, improve predictability and transparency in fiscal transfers. Third, respect the constitutional limits of the Governor's office and other institutions. Fourth, improve inter-state dispute resolution through reliable data and timely negotiation.

Fifth, allow appropriate flexibility in centrally supported schemes. Sixth, strengthen local governments through meaningful devolution of functions, finances and functionaries. Seventh, encourage cooperative planning for shared rivers, environmental challenges, infrastructure and disaster management.

Federal reform should aim not simply to maximize either Union or state power, but to improve constitutional accountability, effective governance and citizens' welfare.

32. Important Supreme Court Judgments

Kesavananda Bharati v. State of Kerala (1973): Established the basic structure limitation on constitutional amendment power.

S. R. Bommai v. Union of India (1994): Strengthened judicial review of Article 356 and emphasized the constitutional importance of federalism.

Government of NCT of Delhi v. Union of India (2018): Explained important principles concerning representative government, constitutional morality and cooperative federalism in the special constitutional framework of Delhi.

Union of India v. Mohit Minerals Pvt. Ltd. (2022): Discussed the persuasive constitutional character of GST Council recommendations.

For examination purposes, distinguish the specific legal issue decided in each judgment from broader political interpretations.
